If you are a civil servant or contract worker DTA: titleContent, the availability allows you to work with an employer other than your home administration. We present you what this form of mobility consists of according to your public service of belonging (State - FPE, territorial - FPT, hospital - FPH) and according to your status (civil servant or contract employee on a permanent contract).

What is the provision?
The provision allows you to work with another employer that your administration while remaining attached to your employer's administration regarding your career and remuneration.
Who can be made available?
You can be made available if you are regular official. The provision is not possible during the internship period.
You must be in activity position.
With which employers can a civil servant be made available?
You can be made available to one of the following administrations or organizations:
- State administration or public institution
- Community or territorial public establishment
- Public health institution
- Body contributing to the implementation of a public policy, to carry out public service missions
- Public Interest Grouping
- Institution or body of the European Union
- International Intergovernmental Organization
- State foreigner, public body under that State or Federated State, provided that your missions maintain a functional link with your home administration
- Foundation, an association recognized as being of public utility, a work or organization of general interest having a philanthropic, educational, scientific, social, humanitarian, sporting, family, cultural or contributing to the enhancement of the artistic heritage, the defense of the natural environment or the dissemination of French culture, language and scientific knowledge (as part of a skills sponsorship, from December 29, 2022 to December 28, 2027).
How does the provision take place?
You can be made available to one or more organizations, for all or part of your service time.
The provision can only take place with your agreement.
The making available shall give rise to a making available agreement between your home administration and the host organization, and then to a release order.
Please note
The making available to an international intergovernmental organization or to an institution or body of the European Union or of a foreigner State, of a public body of that State or of a federated State shall give rise to mission letter which shall be deemed to be a supply agreement.
The making available order shall state:
- The organization(s) with which you perform your service
- And the amount of time you work within each of them.
You continue to benefit in your body of belonging from increments and possibly grade advances and internal promotion.
If you are made available as part of a skills sponsorship, your employer administration examines the compatibility of the activity envisaged within the host organization with your functions over the last 3 years.
What is the content of the making available agreement?
The agreement between your home administration and the host organization covers the following:
- Nature of your activities in the host organization
- Conditions of employment (including place and duration of work)
- Conditions for monitoring and evaluating your activities.
If you are made available to a public or private body contributing to the implementation of a public policy, the making available agreement specifies which public service tasks are entrusted to you.
All change of one of those constituent elements of the Convention is the subject of a endorsement to the convention, and then to a new decree.
The agreement, and possibly its amendments, are sent to you before signature so that you give your agreement on the nature of the activities entrusted to you and on your conditions of employment.
If you are made available to several organizations, an agreement is concluded between your home administration and each host organization.
What is the duration of the availability?
The duration of the provision varies according to the host organization:

Making available to a public administration or institution of the State
If you are made available to perform your entire service and if your provision continues beyond 3 years, you are offered to be detached or directly integrated in your administration or host institution if there is a body level comparable to your original body.
If you accept this offer of secondment or direct integration, you continue to perform the same functions.
If you are seconded, the length of service completed during your secondment is taken into account in the calculation of the 5 years of secondment at the end of which your administration or host institution must offer you integration into your host body.
Making available as part of a skills sponsorship
Your provision is pronounced for a maximum duration of 18 months, renewable up to a total duration of 3 years.
Your availability may not go beyond 28 December 2027.
Other cases of making available
The duration of the making available shall be fixed in the order making it.
The making available may be pronounced for a maximum duration of 3 years.
It may be renewed for periods of up to 3 years.
How is one paid during the provision?
While you are at your disposal, you continue to be paid by your home administration.
You can perceive a top-up by your host organization, in accordance with the rules applicable to the staff of that organization. If applicable, the nature of the additional remuneration shall be specified in your contract of supply.
You can also be compensated by your fee-receiving organization and subjections to which you are subject in the course of your duties according to the rules in force in this organization.
What are the working conditions during the provision?
You are subject to the rules of organization and operation of your reception service.
Your direct supervisor or the person responsible for your host organization reports on how you are serving.
This report, written after an individual interview, is first sent to you. You can comment on that.
This report is then sent to your home administration, which uses it as a support to assess your professional value.
What leave is a staff member entitled to?
You are entitled to the same leave as if you were working in your home administration.

Annual and sick leave
It's your host administration who grants you your annual leave (and enhanced if you are entitled to it) and sick leave.
If you are placed at the disposal of several host administrations, your placement agreement specifies which one grants you this leave after informing the other host administrations.
However, if you are made available for a working time equal to or less than half-time, it is your home administration that grants you annual and sick leave.
If you are made available to a public interest groupHowever, it is also your home administration that grants you annual and sick leave, after consulting the public interest group.
Other leave
It's your administration of origin who grants you the following leave after consulting your host organization:
- Long-term Sick Leave (LSL)
- Long Term Leave (LTL)
- Temporary Service Disability Leave (Citis)
- Maternity leave
- Adoption Leave
- Birth or adoption leave of 3 days
- Paternity and childcare leave
- Vocational Training Leave
- Leave for Validation of Experience (VAE)
- Leave for skills assessment
- Leave for Union Training
- Health and safety training leave of up to 2 days if you are a staff representative on the social committee
- Leave to participate in the activities of youth and popular education organizations, federations and approved sports associations
- Family solidarity leave
- Caregiver Leave
- Leave of representation
- Parental Presence Leave.
If you are placed on leave for temporary service disability (Citis), your administration of origin covers your remuneration and the medical fees and expenses directly caused by the illness or accident.
If you can benefit from temporary invalidity allowance (Ati), it shall be paid to you by your administration of origin.
If you are placed on vocational training leave, this is your administration of origin who pays you your lump sum compensation.
Training under the CPF
It's your administration of origin which provides you with training as part of the Personal Training Account (PTA) and who pays you your training allowance.
Part-time
It's your administration of origin that grants you the part-time.
How is one reintegrated into the original administration?
At the end of your assignment, you are reassigned to your previous job in your original department.
If this is not possible, you are reassigned to a job corresponding to your grade.
The availability may end before the date scheduled at your request or at the request of your home administration, or of your host organization.
Your availability agreement may provide for a period of notice.
If you are made available to several organizations, the end of the provision may apply to only a part of them.
In this case, the other host organizations are informed of the anticipated end of your availability.

The making available can only take place with your agreement and after the deliberative assembly of your community or institution of affiliation has been informed.
The making available shall give rise to a making available agreement between your home administration and the host organization, and then to a release order.

If you are made available to perform your entire service and if your provision continues beyond 3 years, you are offered to be transferred, detached or directly integrated in your host community or institution if there is a employment framework at a level comparable to your original employment framework.
If you accept this offer of secondment or direct integration, you continue to perform the same functions.
If you are seconded, the length of service completed during your secondment is taken into account in the calculation of the 5 years of secondment at the end of which your administration or host institution must offer you integration into your host body.
Making available as part of a skills sponsorship

Annual and sick leave
It's your host administration or organization who grants you annual leave (and enhanced if you are entitled to it) and sick leave.
If you are made available to several administrations or organizations, this is your community of origin who grants you such leave after agreement of the host administrations or organizations.
In the event of disagreement between these authorities or bodies, your community of origin you are granted annual and sick leave based on the choice of the organization that employs you the longest.
If two or more host administrations or organizations employ you for the same period of time, your home community will grant you leave and its decision is binding on them.
However, if you are made available for less than or equal to half-time, your home community grants you annual and sick leave.
If you are made available to a public interest group, it is also your home community that grants you annual and sick leave, after consulting the public interest group.
Your home community pays for you during periods of sick leave.

If you are made available to perform your entire service and if your provision continues beyond 3 yearsHowever, it is suggested that you be integrated into your host institution through the change of establishment if there is a body of comparable level to your original body.

The making available may be pronounced for a maximum duration of 3 years.
It may be renewed for periods of up to 3 years.
How is one paid during the provision?
While you are at your disposal, you continue to be paid by your home administration.
