Caregiver Leave in the Public Service

One of your relatives is handicapped or in loss of autonomy ? You can, in some cases, temporarily stop your activity or work part-time, as part of a caregiver leave, to take care of him. We detail the information you need to know according to your public service (state - FPE, territorial - FPT, hospital - FPH).
What applies to you ?

In what case can caregiver leave be granted?
You can ask to temporarily cease your professional activity or from working part-time on caregiver leave to take care of a family member with a disability or loss of autonomy.
The person accompanied may be one of the following:
- Your spouse
- A child in your care (as defined in family benefits)
- One ascending
- One descendant
- One collateral until 4th degree
- An ascendant, descendant or collateral up to 4e degree of your spouse
- An elderly or disabled person with whom you reside or have close and stable ties, and to whom you regularly and frequently assist, in a non-professional capacity, to carry out all or part of the acts or activities of daily life.
Your employer administration cannot deny you leave.
How long is the caregiver leave?
The duration of the leave shall be 3 months maximum renewable within one year over your entire career.
You can take your leave in one of the following ways:
- In one continuous period
- In a fractional way in periods of at least half a day
- In the form of a part-time.
Condition of use caregiver leave | Length of leave count |

- The duration equal to the ratio between the duration of leave taken in the form of part-time and the duration resulting from the service obligations laid down for full-time staff to be counted in days or half-days.
How to apply for caregiver leave?
In order to benefit from caregiver leave, you must send an employer to your administration written request, at least one month before the start of the leave.
In case of renewal of your leave, you must send your written request at least 15 days before the end of your current leave period.
You must indicate in your application the projected dates of leave and the how you want to use it (on a continuous, split or part-time basis).
In support of your application, you must provide following supporting documents :
- Declaration of the honor of your family relationship with the person being helped or of the assistance provided to an elderly or disabled person with whom you reside or have close and stable ties
- Sworn statement stating that you have not previously been on caregiver leave or the length of time you have been on caregiver leave.
Your application must also be accompanied by a copy of one of the following documents:
- Copy of the decision showing a permanent incapacity rate at least equal to 80% if the person being helped is a dependent disabled child or a disabled adult
- Copy of the award decisionPersonalized Autonomy Allocation (Apa) if the person being helped suffers from a loss of autonomy.
If the person receiving the assistance is receiving one of the following benefits, you must also attach a copy of the decision awarding the benefit:
- Constant Third-Party Assistance mark-up or additional benefit for third-party use
- Special increase for third-party assistance in the pension of an official
- Markup of temporary invalidity allowance
- Third-party surcharge on military pension.
You can modify the planned dates and the chosen terms of use of your leave. You must inform your employer administration in writing at least 48 hours in advance.
In case of emergency, the time limits for requesting, renewing or amending leave shall not apply in the following cases:
- Sudden deterioration in the health of the person being helped
- Crisis situation requiring urgent action on your part
- Abrupt cessation of residential accommodation for the assisted person.
In this case, the leave may start or be renewed without delay.
You must transmit, within 8 days, to your employer administration, one of the following documents:
- Medical certificate attesting to the sudden deterioration of the health of the person being helped or the crisis situation requiring urgent action on your part
- Certificate of abrupt cessation of residential accommodation.
You can terminate or waive your leave early in the following cases:
- Death of the person assisted
- Admission of the assisted person to an institution
- Significant decrease in your resources
- Use of a home help service to assist the person being helped
- Caregiver leave taken by another family member
- If your health condition requires it.
You must inform your employer administration in writing at least 15 days before the date on which you wish to end or waive your leave.
In the event of the death of the assisted person, this period is reduced to 8 days.
How is caregiver leave paid?
Caregiver leave is not remunerated. But, you can benefit from a Caregiver's Daily Allowance (AJPA) from the Caf: titleContent.
To do this, you must fill out a form and send it to your Caf:

Your application for the allowance must be accompanied by a certificate from your employer's administration stating that you are on caregiver leave.
The amount of the allowance shall be €66.64 per day and to €33.32 per half day.

In Mayotte, the amount of the allowance is fixed at €58.31 per day and at €29.16 per half day.
You can benefit from the maximum of 22 daily allowances during a calendar month.
The total number of daily allowances which may be paid for the same person accompanied by 66.
If you have received 66 daily allowances, you can once again receive 66 daily allowances if you are assisting a different person the one for which you previously received the allowance. These 66 new allowances may be granted up to a maximum of 22 per calendar month.

Time spent on caregiver leave is taken into account when determining the length of service required for entitlement to certain leave. This is particularly the case for the vocational training leave , on sick leave, on parental leaveetc.
The time spent on family caregiver leave is also taken into account when determining the length of service required for entitlement to part-time to raise a child or part-time for personal reasons.
Periods of family caregiver leave are taken into account for old-age caregivers' insurance (Ava) as for a private sector employee.

In case of emergency, the time limits for requesting, renewing or amending leave shall not apply in the following cases:

How is caregiver leave paid?
Caregiver leave is not remunerated. But, you can benefit from a Caregiver's Daily Allowance (AJPA) from the Caf: titleContent.
To do this, you must fill out a form and send it to your Caf:

Your application for the allowance must be accompanied by a certificate from your employer's administration stating that you are on caregiver leave.
The amount of the allowance shall be €66.64 per day and to €33.32 per half day.

In Mayotte, the amount of the allowance is fixed at €58.31 per day and at €29.16 per half day.
You can benefit from the maximum of 22 daily allowances during a calendar month.
The total number of daily allowances which may be paid for the same person accompanied is fixed at 66.
If you have received 66 daily allowances, you can once again receive 66 daily allowances if you are assisting a different person the one for which you previously received the allowance. These 66 new allowances may be granted up to a maximum of 22 per calendar month.
The maximum number of daily allowances that may be paid to you over your entire career is set to 264.
If you take part-time leave, the monthly AJPA amount is calculated based on the number of days or half-days not worked during the month.
Example :
If you take part-time leave, you can receive a maximum of 11 AJPA per month.
In the event of the death of the accompanied person, the AJPA continues to be paid for the days not worked taken during the month of death.
If you end the leave early or waive it due to the death of the accompanied person, you can ask the Caf: titleContent the cessation of the payment of the AJPA from the day following the death.
What are the effects of caregiver leave on the administrative situation of the staff member?
You remain assigned to your job during your caregiver leave.
If your job is terminated or converted, you are given priority to be reassigned to a job corresponding to your grade or seconded or integrated directly into another corps.
The time spent on caregiver leave is treated as a period of actual service and is taken into account for the calculation of your pension insurance period and for the calculation of the amount of your retirement pension.
In what case can caregiver leave be granted?
You can ask to temporarily cease your professional activity or from working part-time on caregiver leave to take care of a family member with a disability or loss of autonomy.
The person accompanied may be one of the following:
- Your spouse
- A child in your care (as defined in family benefits)
- One ascending
- One descendant
- One collateral until 4th degree
- An ascendant, descendant or collateral up to 4e degree of your spouse
- An elderly or disabled person with whom you reside or have close and stable ties, and to whom you regularly and frequently assist, in a non-professional capacity, to carry out all or part of the acts or activities of daily life.
Your employer administration cannot deny you leave.
How long is the caregiver leave?
The duration of the leave shall be 3 months maximum renewable within one year over your entire career.
You can take your leave in one of the following ways:
- In one continuous period
- In a fractional way in periods of at least half a day
- In the form of a part-time.

- The duration equal to the ratio between the duration of leave taken in the form of part-time and the duration resulting from the service obligations laid down for full-time staff to be counted in days or half-days.
How to apply for caregiver leave?
In order to benefit from caregiver leave, you must send an employer to your administration written request, at least one month before the start of the leave.
In case of renewal of your leave, you must send your written request at least 15 days before the end of your current leave period.
You must indicate in your application the projected dates of leave and the how you want to use it (on a continuous, split or part-time basis).
In support of your application, you must provide following supporting documents :
- Declaration of the honor of your family relationship with the person being helped or of the assistance provided to an elderly or disabled person with whom you reside or have close and stable ties
- Sworn statement stating that you have not previously been on caregiver leave or the length of time you have been on caregiver leave.
Your application must also be accompanied by a copy of one of the following documents:
- Copy of the decision showing a permanent incapacity rate at least equal to 80% if the person being helped is a dependent disabled child or a disabled adult
- Copy of the award decisionPersonalized Autonomy Allocation (Apa) if the person being helped suffers from a loss of autonomy.
If the person receiving the assistance is receiving one of the following benefits, you must also attach a copy of the decision awarding the benefit:
- Constant Third-Party Assistance mark-up or additional benefit for third-party use
- Special increase for third-party assistance in the pension of an official
- Markup of temporary invalidity allowance
- Third-party surcharge on military pension.

You remain assigned to your job during your leave.
If the service requirements do not allow it, you are dismissed and have a priority to be re-employed on a similar job with equivalent pay.
Time spent on caregiver leave is taken into account when determining the length of service required for entitlement to certain leave. This is particularly the case for the vocational training leave , on sick leave, on parental leaveetc.
The time spent on family caregiver leave is also taken into account when determining the length of service required for entitlement to part-time to raise a child or part-time for personal reasons.
Periods of family caregiver leave are taken into account for old-age caregivers' insurance (Ava) as for a private sector employee.
The Caf: titleContent automatically enrolls you and pays the old-age insurance contributions.
