Temporary Disability Allowance (TIA) in the Public Service

A permanent official temporarily incapacitated, who has exhausted his sick leave entitlements and that is not admitted to retirement for invalidity, may benefit from a Temporary Invalidity Allowance (TIA) if he has disability reducing at least 2/3 of his working capacity. We present you the information to know.

Temporary Invalidity Allowance (TIA) should not be confused with temporary invalidity allowance (Ati).

Temporary Disability Allowance (TIA) may be granted to you if you meet the following 4 conditions :

  • You have exhausted your rights to sick leave, long-term illness (CLM) or to long-term leave (LTC)
  • Your medical condition does not allow you to resume your duties and you are not eligible for disability retirement
  • You are placed in office availability and you are not entitled to daily sickness benefit (DSA)
  • You have a disability that reduces your work capacity by at least 2/3.

To qualify for the Temporary Invalidity Allowance (TIA), you must be civil servant of the State or territorial or hospital staff member affiliated to the CNRACL: titleContent.

You must apply to your employer administration for recognition of your temporary disability.

The request is made using form cerfa n°52406:

You must complete the box that concerns you, then send the form to your employer administration.

Your employer administration, after completing the part that concerns it and having requested the necessary additional documents, sends the request to the medical service of the CPAM: titleContent which you report to.

The request must be made within one year of:

  • From the end date of your sick, long-term or long-term leave
  • Or the end date of receipt of the daily sickness benefit
  • Or the date of the consolidation of your injury or the date of stabilization of your health.

The CPAM decides on the allocation of the temporary invalidity allowance, taking into account indicative scale to determine your disability rate.

To determine the amount of the allowance, CPAM classifies you in one of the following 3 groups:

  • 1er group: Disabled person capable of gainful employment
  • 2e group: Disabled person absolutely unable to practice any profession
  • 3e group: Invalid who, being absolutely incapable of exercising a profession, is also obliged to have recourse to the assistance of a third person to perform the ordinary acts of life.

The CPAM you notified its decision and inform your employer administration.

The temporary invalidity allowance is granted by the CPAM from the end date of your sick leave, long-term sick leave or long-term sick leave or from the end date of receipt of the daily sickness allowance.

The temporary invalidity allowance is granted for a maximum renewable period of 6 months.

The application for renewal shall be made in accordance with the same procedure as the initial application.

By disability group in which you have been classified, the amount of the temporary invalidity allowance is equal to sum of the following:

If you are classified in 1er group, the sum of the share of the index salary and the share of the residence allowance may not exceed €1,201.50.

If you are classified in the 2e or the 3e group, the sum of the share of the index salary and the share of the residence allowance may not exceed €2,002.50.

In addition, if you are classified in the 3e the sum of the share of the index salary and the share of the residence allowance shall be increased by 40%. This increase is not paid in the case of hospitalization.

The temporary invalidity allowance shall be paid by your employer administration.
