What is the ex officio availability for health reasons of the incumbent official?

If you are an incumbent public servant, you may be automatically placed on standby for health reasons in certain circumstances. During your availability, you may receive, in some cases, a replacement income. We detail the rules applicable to the automatic availability for health reasons according to your public service (State - FPE, territorial - FPT, hospital - FPH).
EPF
If you are incumbent official, you may be automatically placed on standby for health reasons when you have exhausted your rights à sick leave or long-term sick leave (LWOP) or long-term leave (LTC).
You may be placed on standby for health reasons when you are in one of the following situations:
- Your state of health does not allow you to return to work at the end of the last period of sick leave, long-term sick leave or long-term leave, but the medical board judges that your state of health will evolve favorably
- Your sick leave entitlements have been exhausted and you are awaiting the medical advice who should determine your situation (return to service, reclassification, lay-off, retirement)
- You have been found unfit for the duties corresponding to your grade at the end of your sick leave and are awaiting reclassification to a job compatible with your state of health.
Reminder
If you are a civil servant trainee or contractor, you are placed in unpaid leave when you have exhausted your sick leave entitlements.
Ex officio availability for health reasons is granted or renewed by 6 to 12 months within the limit of 6 consecutive years.
If at the end of the 6e year of availability, you are unfit to return to duty, but if it is the medical board's opinion that you should normally be able to return to duty before the end of a new year, your availability may be renewed a 7e times.
The compulsory lay-off for health reasons and its renewal shall be pronounced by the administration after notice of the medical advice.
The automatic availability for health reasons is not remunerated but you can receive a replacement income variable according to your situation.
Compensation equal to index salary
If you are temporarily automatically placed on standby pending the opinion of the medical council, you receive compensation equal to the amount of the index salary and, possibly, bonuses and allowances that you received at the end of your last period of sick leave.
You receive this allowance until the date of the decision to return to service, reclassification, lay-off or retirement.
Daily allowances
You can collect daily allowances (IJ) from your employer administration if your automatic availability occurs at the end of a sick leave of a year.
As a public servant on sick leave, you cannot be compensated less by your employer administration than you would be if you were compensated by Social Security. Under the general social security system, the period of payment of daily allowances may be up to 3 years in the event oflong-term condition (ALD).
Your employer's administration therefore asks the Social Security doctor to find out if he recognizes you as an ALD and if you can benefit from daily allowances. His opinion is binding on your administration.
If you are entitled to it, the amount of your daily allowance (IJ) is calculated under the conditions laid down in the general social security scheme.
It is equal to half of your index treatment and your residence allowance, within the limit of €42.97, to which is added the family treatment supplement (FTS) in full, if you receive this additional remuneration.
The new index increase (NBI) and the additional salary is not taken into account to calculate the amount of your daily allowance.

The daily allowance shall be subject in full to the CSG: titleContent at the rate of 6.2% and to the CRDS: titleContent at the rate of 0.5% and is taxable.
Temporary Disability Allowance (TIA)
If you are not entitled to the daily allowance and your temporary disability reduces your work capacity by at least 2/3, you can perceive theTemporary Invalidity Allowance (TIA).
Unemployment benefits
If you are not entitled to the daily allowance or the temporary invalidity allowance (TIA), you can receive unemployment benefits.
The standby period is not a period of actual service.
It shall not be taken into account for advancement to step and grade.
At the end of the last standby period, your situation is subject to medical advice and depends on your physical fitness.

You may be placed on standby for health reasons when you are in one of the following situations:

The duration of automatic availability for health reasons is up to one year.
It can be renewed twice for the same duration.
Yes, at the end of the 3e year of availability, you are unfit to return to service, but if it is the medical board's opinion that you should normally be able to resume your duties or be reclassified before the end of a new year, your availability may be renewed a 3e times.
The compulsory lay-off for health reasons and its renewal shall be pronounced by the administration after notice of the medical advice.
Automatic availability for health reasons is not remunerated but you can receive a variable replacement income depending on your situation.
Maintenance of half-treatment
If you are temporarily placed on involuntary lay-off pending medical advice, you will continue to receive your half-pay until the date of the decision to return to service, reclassification, lay-off or retirement.
This maintenance of remuneration pending the opinion of the medical board does not apply to bonuses and allowances.
In this situation, you are not in a statutory position that involves the performance of actual services. This period is therefore not taken into account for retirement even though you contribute to the CNRACL: titleContent.
