Family solidarity leave allows you to reduce or stop your professional activity to accompany a loved one at the end of life. We detail the conditions for granting this leave according to your public service of affiliation (State - FPE, territorial - FPT, hospital - FPH) and according to whether you are a civil servant or a contractor.

What are the conditions for receiving family solidarity leave?

You are entitled to family solidarity leave if the following two conditions are met:

  • You are in activity or secondment
  • One of your loved ones has a life-threatening condition or is in the advanced or terminal stages of a serious and incurable condition, regardless of the cause.

Family solidarity leave allows you to reduce or stop your professional activity to accompany this loved one at the end of life.

The person you wish to accompany must be a ascending, one descendant, a brother, sister or person who shares your home or has designated you as his trusted person.

The person accompanied may live at his own home, at your home, at the home of a third party or in Ehpad: titleContent.

How long is the family solidarity leave?

Family solidarity leave may consist, at your choice, of a period of complete cessation of activity or a period of part-time work.

If you completely cease your activity, you can choose to take your leave as follows:

  • In the form of a continuous period of 3 months maximum, renewable 1 time
  • Or split way, as periods of at least 7 consecutive days, the cumulative duration of which may not exceed 6 months.

If you choose to reduce your professional activity, you can take your leave in the form of part-time work at 50%60%, 70% or 80% for a maximum period of 3 months, renewable 1 time.

Reminder

Family solidarity leave cannot be deducted from the duration of the annual leave.

How is family solidarity leave paid?

Family solidarity leave is not paid.

But you can receive, during part of your leave, a daily allowance to accompany a person at the end of life.

The amount of the allowance varies depending on whether you are completely out of business or working part-time.

Cessation of activity

The amount of the allowance shall be €64.92 per day.

It can be paid to you during 21 days maximum.

Reminder

When one or more other persons accompany your family member at the end of life and also benefit from the support allowance, the total number of daily allowances of the various beneficiaries may not exceed 21.

Part-time

The amount of the allowance shall be €32.46 per day, regardless of the chosen working time.

It can be paid to you during 42 days maximum.

Reminder

When one or more other persons accompany your relative at the end of life and also receive the accompanying allowance, the total number of daily allowances of the various beneficiaries may not exceed 42.

The allowance is paid to you by your employer administration for each day of leave, whether it is workable or not.

If you take your leave on a split basis and the accompanied person dies before the end of the 7-day period, the allowance is paid for the days between the date of receipt of your leave request and the day after the death.

If the accompanied person is hospitalized after payment of the allowance begins, the allowance continues to be paid during the days of hospitalization.

How to apply for family solidarity leave?

You have to make a written request and accompany it with a attestation from the doctor of the sick person.

Your application must include the following information :

  • Surname, first name and social security number of the person accompanied and contact details of his social security fund
  • Number of daily allowances desired depending on whether you choose to stop working or to work part-time
  • If applicable, the names of the other beneficiaries of the accompanying allowance and the distribution of the daily allowances between you. The total number of daily allowances of the various beneficiaries may not exceed the maximum number of days allowed (21 days in case of interruption of activity, 42 days in case of part-time work).

Your employer administration cannot deny you leave.

With regard to the payment of daily allowances, your employer administration shall inform, within 48 hours upon receipt of your request, the social security fund to which the person accompanied belongs.

In the absence of a response from the social security fund within 7 days upon receipt of your application, the allowance is considered granted.

The payment of daily allowances shall begin at the end of the month in which the social security fund of the person accompanied has given its consent.

What are the effects of family solidarity leave on the official’s administrative situation?

Career

Family solidarity leave shall be considered as a period of effective service.

It is therefore taken into account for theadvancement step and grade and for the internal promotion.

It does not reduce your entitlement to other leave, including:

Duration of the internship

If you are a probationary civil servant, the end date of your probationary period is postponed by a number of working days equal to the number of days of family solidarity leave used.

The family solidarity leave is fully taken into account in the calculation of the services retained for your classification at your tenure.

RTT

Family solidarity leave is not taken into account for the calculation of your RTT.

Transportation costs home - work

The support of transportation costs home - workplace shall be suspended during the period of family solidarity leave.

However, care is maintained until the end of the month in which the leave begins.

When the return to service following the leave takes place in a subsequent month, care shall be taken for that entire month.

Retirement

You can request that your family solidarity leave be taken into account for retirement.

It is then taken into account for the calculation of your number of quarters of pension insurance and for the calculation of your number of liquid quarters when calculating the amount of your pension.

You must submit your request to your employer's administration within 6 months of the end of your leave.

You must make your request by registered mail with acknowledgement of receipt or hand delivered against discharge.

In order for your family solidarity leave to be taken into account for your retirement, you must make a special contribution equal to the contribution that would have been levied if you had worked and had not benefited from the leave.

This special contribution is levied each month up to 5% your net index processing, except for the last direct debit for balance.

If you are removed from the management team before you have been able to pay this special contribution in full, the duration of your family solidarity leave is fully taken into account for your retirement. The remaining amounts due are deducted from the amount of your pension, up to a maximum of 5e per month.

You can, at any time, pay the full amount of the special contribution due or remaining.

How does family solidarity leave end?

Family solidarity leave ends at the end of the maximum permitted period (3 or 6 months) or within 3 days of death of the person accompanied.

You can also request the end of your leave before the date originally scheduled. In this case, if you are a hospital agent, you must respect a notice of 3 clear days.

You remain posted to your job during your family solidarity leave.

However, if your job is terminated, you will be assigned to one of the jobs corresponding to your grade closest to your former place of work.

You can apply to be posted to a job closer to home.

What are the effects of family solidarity leave on the administrative situation of the staff member?

Administrative situation

Family solidarity leave is considered a period of actual service.

It is taken into account for the determination of seniority-related benefits: review of your pay conditions every 3 years, opportunity to compete in internal competitions, etc.

RTT

Family solidarity leave is not taken into account for the calculation of your RTT.

Transportation costs home - work

The support of transportation costs home - workplace shall be suspended during the period of family solidarity leave.

However, care is maintained until the end of the month in which the leave begins.

When the return to service following the leave takes place in a subsequent month, care shall be taken for that entire month.

How does family solidarity leave end?

Family solidarity leave ends at the end of the maximum allowed duration (3 or 6 months) or within 3 days of death of the person accompanied.

You can also request the end of your leave before the date originally scheduled.

At the end of the leave, you are re-employed on your previous job to the extent permitted by the service. If this is not possible, you are dismissed and have priority re-employment at your institution to perform similar functions with equivalent remuneration.
