Éhpad: accommodation facility for dependent elderly people

What is a Ehpad: titleContent ? This is a medical facility (formerly retirement homes) where people, usually at least 60 years of age, are accommodated and need daily care and assistance. These individuals reside there on a part-time or full-time basis, either temporarily or permanently. Under certain conditions, they can obtain assistance to pay the Éhpad bill. We explain.

To be admitted in Ehpad: titleContent, the following conditions must be met:

  • Credit memo at least 60 years
  • Credit memo need for daily care and support to do the acts of everyday life (for example, get up, eat meals).

Please note

An Ehpad may have a waiver that allows it to host persons under 60. This exemption is granted by the administration of the department where the Ehpad is located.

One Ehpad: titleContent provides permanent or temporary accommodation for elderly people on a full or part-time basis. It provides the elderly with medical and paramedical care adapted to their state of health. It provides assistance adapted to daily life. It also carries out prevention and health education activities.

Here is the list of the main differences between Ehpad:

  • Most nursing homes are general practitioners and can accommodate several Alzheimer's patientsHowever, some nursing homes specialize in the management of this disease.
  • Some nursing homes are authorized to accommodate people who may receive social assistance in accommodation (ASH).
  • An Ehpad may have a waiver, granted by the services of the department where it is located, to accommodate persons under 60 years of age.
  • Some Ehpads offer optional benefits (e.g. hairdressing service).

An Ehpad provides at least the following services:

  • General administration (inventory, family liaison document, residence contract or individual care document)
  • Hospitality (provision of a room, access to a bathroom with at least one sink, a shower and toilets, access to television, telephony and internet, lighting, heating, maintenance and cleaning of premises...)
  • Catering (access to a catering service, daily provision of 3 meals, a snack and a night snack)
  • Laundry services (provision and maintenance of bed, table and toilet linen, marking and maintenance of personal linen)
  • Animation (collective animation inside and outside the Ehpad).

Other services may be offered in addition (for example, hairdressing).

An Ehpad must have a multidisciplinary team of professionals comprising at least:

  • A coordinating doctor
  • A nurse coordinator and holder of the state diploma
  • A nurse with a state diploma
  • Nursing aides
  • Medico-psychological help
  • Educational and social coaches
  • Psycho-educational personnel.

The form must be addressed to the Ehpad of his choicepreferably by registered letter with acknowledgement of receipt.

Application for admission to residential care for dependent elderly people (Éhpad)

This admission file must be completed in 1 copy and photocopied according to the number of Ehpad chosen.

It is preferable to carry out several simultaneous applications for admission in several nursing homes.

As soon as a place becomes available, management contacts the elderly person to consider the possibility of admission. It is the head of the hospital who decides the admission after having gathered the opinion of the doctor coordinating the structure.

The elderly person may refuse entry to the nursing home if they have found another place elsewhere or if they have changed their mind.

The nursing home and the elderly person (or with the person responsible for the legal protection measure) must conclude together a residence contract (or an individual document), as soon as the duration of the accommodation can be more than 2 months.

The residence contract must be signed :

  • For a home entitled to ASH, the residence contract must be given to the elderly person, at the latest within 15 days of admission. The contract must be signed within one month.
  • For other nursing homes, the residence contract must be signed prior to the admission of the elderly person.

The contract must indicate in particular the following information:

  • Definition of support objectives
  • Description of the conditions of stay and reception
  • Method of calculation, and financial contribution, for each benefit or set of benefits, including in the event of absence or hospitalization
  • Right of withdrawal
  • List of mandatory minimum services (accommodation and maintenance of premises, means of communication including Internet, catering, laundry including the provision, maintenance and renewal of laundry, medical supervision, entertainment...)
  • Mention of the annual change in the rate of services.

Dependency Rate

Rate payable by the elderly person

It varies according to the state of dependency of the elderly person. The more dependent the older person is, the higher the amount.

The state of dependence is evaluated by the coordinating physician of the Ehpad using the Aggir grid.

Costs related to the assistance and supervision necessary for the performance of everyday acts.

Care rates

Rate payable by the Health Insurance

  • Medical equipment costs
  • Expenses of nursing staff

There are 3 aids to the payment of the accommodation rate and the dependency rate of the Ehpad:

  • Personalized Autonomy Allocation (Apa) which is used to pay part of the dependency rate billed by the Éhpad. This assistance is granted to the elderly person whose loss of autonomy is classified as Gir 1, Gir 2, Gir 3 or Gir 4. A person classified as Gir 5 or Gir 6 is not entitled to the Apa.
  • Housing assistance (ALS or APL) which is used to pay part of the accommodation rate billed by the Éhpad.
  • Social assistance in accommodation (ASH), which is paid to the elderly person when they are housed in certain nursing homes only.

These aids are cumulative.

An elderly person in a nursing home may also receive an energy check.

If it's taxable, it can get a tax reduction not exceeding €2,500.

It is also possible to know whether an Ehpad qualifies for ASH or not.

A nursing home can ask the elderly person's support staff (children, grandchildren, sons-in-law or daughters-in-law) to sign a deed of joint and several guarantee. By this act of joint and several guarantee, they undertake to pay the accommodation costs of the elderly person, when the latter is no longer able to do so.

Where the elderly person is a beneficiary of the ASH, the act of joint and several guarantor may relate only to the part of the cost remaining to be borne by the elderly person.

The Éhpad can request the payment of a security deposit (money). Its amount must not exceed monthly accommodation rate which remains the responsibility of the person accommodated.

When the elderly person leaves the nursing home permanently, the security deposit must be returned to them within 30 days of their date of departure. The amount returned may be reduced by any receivable.

The date of discharge from the nursing home corresponds to the date of the inventory, carried out in a contradictory manner, at the time of the departure of the elderly person.

When an elderly person enters a nursing home, the nursing home:

  • Proposes to designate a trusted person, if it has not already done so.
  • Suitable with it (and its trusted person) or the person in charge of a legal protection measure, personalized support project. It is a care project and a life project defining the aspirations and choices of the elderly person in the short, medium and long term.
  • Hands him (or her) trusted person) and to the person in charge of the legal protection measure, a welcome booklet. This welcome booklet contains in particular a charter of rights and freedoms of the person hosted, which must also be posted in the Ehpad. The welcome booklet also contains the operating regulations. This regulation defines the rights of the person housed and the obligations and duties necessary to respect the rules of collective life in the Ehpad.

During the stay of the elderly personEvery day, the elderly person can receive any visitor of his choice, without having to inform the nursing home beforehand.

But the director of the Éhpad can oppose a visit:

  • Either because it poses a threat to public order in or around the Éhpad
  • Either because the coordinating physician or any other health professional, considers that this visit constitutes a threat to the health of the elderly person, other residents or people working in the nursing home.

When the elderly person is at the end of lifeHowever, it is not possible to deprive her of the daily visit of any person of her choice. When she cannot express a choice, it is not possible to deprive her of the visit of any member of her family, her entourage, or the person of trust she has designated.

The nursing home must define the conditions to ensure these visits and to ensure compliance with the necessary instructions to protect the health of the elderly person, other residents and visitors.

Some nursing homes allow the elderly to be accommodated with their pets. For this, the elderly person must respect certain conditions.

Please note

It's at Éhpad's Council for Social Life whether or not to allow the accommodation of elderly people with their pets. The conditions imposed on the elderly person are identical, regardless of the home.

Within 15 days of signing the residence contractor the admission of the elderly person to the nursing home, if later, the elderly person (or the person responsible for the legal protection measure) may exercise a right of withdrawal in writing without a notice period being imposed on him. The elderly person must pay the price for the length of the stay they have made.

After this time limit, the elderly person (or the person responsible for the legal protection measure) may terminate the residence contract in writing at any time. From the notification of her decision at the Éhpad, she has a 48-hour cooling-off period during which she can reconsider her decision, without having to justify a reason. This cooling-off period is included in the notice period that may be imposed on it. The notice period must be stated in the residence contract.

One state of arrival of the room must be done in a contradictory way, when the elderly person is settled in a nursing home.

When the elderly person leaves the institution, or dies, a state of the exit of the house must be done in a contradictory way.

The Éhpad can claim a restoration fee if the state of the exit site does not conform to the state of the arrival site. These fees do not apply to damage due to dilapidated places.

However, where an inventory has not been made at the time of the arrival and departure of the elderly person, the Éhpad cannot claim any amount for the rehabilitation.

FYI  

In the event of the death of the elderly person, the exit inventory indicates the date of withdrawal of his personal items. If these items are not removed from the room within 6 days of death, the Hospital may charge occupancy fees. The amount claimed may not exceed that corresponding to the base of benefits due for a maximum period of 6 days.

In order to vote, the elderly person may have to re-register on the electoral roll.

FYI  

To prove his new address in the commune of the Ehpad, the elderly person can provide a certificate (less than 3 months) of the director of the Ehpad, certifying the reality of his accommodation and indicating the address of the Ehpad.

The elderly person may vote by traveling to the polling station, or by making a proxy of vote.

Please note

If the elderly person cannot travel to have their power of attorney issued, they can request that a police or gendarmerie officer come to the nursing home. The elderly person must make the request in writing, attaching a certificate of honor that she is unable to move.

Who shall I contact

The Éhpad may terminate the residence contract in one of the following situations:

  • The elderly person does not comply with an obligation related to the residence contract or the operating regulations of the Ehpad. However, when a medical opinion finds that this situation results from an impairment of mental or bodily faculties, the Ehpad cannot terminate the residence contract
  • The Éhpad is closed
  • The elderly person ceases to meet the admission conditions, or his state of health requires equipment or care not available in the nursing home on a permanent basis.
