Social assistance for the accommodation (ASH) of an elderly person

The ASH is used to pay all or part of the accommodation costs charged by the establishment (Ehpad: titleContentresidence, autonomy, USLD: titleContent) or family care for the elderly. The HSO pays the difference between the amount of accommodation costs and what the elderly person can pay, or even what their parents can pay compelled to support (children, sons-in-law, stepdaughters). The department can recover the ASH paid, from the living and death of the elderly person. We present you the information to know.

In institution

To obtain the HSA, the elderly person must meet all of the following conditions:

  • She must be over 65 (or over 60 if she has been found unfit for work)
  • She must live in France on a stable and regular basis. If she is a foreign national, she must also have a valid residence permit.
  • It must be accommodated in an establishment (Ehpad or residence autonomy or USLD) which has places reserved for recipients of social assistance
  • Its revenues must be lower than the accommodation costs charged by the establishment.

ASH is paid in some residential facilities for dependent elderly people (Éhpad), or residences autonomy, or Long-Term Care Units (LTCUs).

Only establishments with places reserved for social assistance recipients are eligible for HSA.

To check whether an establishment qualifies for ASH, it is possible to consult the directory of establishments.

You must complete the ASH application file available at the town hall or the CSF: titleContent of the municipality where the elderly person lives.

Who shall I contact

Certain supporting documents must be provided, including the following:

  • Identity document of the elderly
  • Proof of residence of the elderly person
  • Notice of taxation of the elderly person and the person with whom they live in a relationship
  • Proof of pensions or wages for the last 3 months, of the elderly person and the person with whom he lives in a couple, and those of his compelled to support
  • List of its compelled to supportaccording to what appears in his family record book.

The town hall or the CCAS then forwards the file and supporting documents to the department.

The decision to award or refuse ASH is notified the elderly person or their legal representative.

In order for accommodation costs to begin to be covered from the date of entry into the establishment, the ASH application must be made within 2 months of that date.

It is therefore recommended to apply for ASH at the same time as the admission procedures.

The ASH is paid by the department. Each department has its own social welfare regulations. The payment rules therefore vary from one department to another.

The department may determine the amount of the HSA by taking into account the income of the following persons:

  • Income of the elderly (except for the combatant recognition allowance and pensions attached to honors, such as the Legion of Honor)
  • Income of spouse, partner of Civil partnerships: titleContent or his cohabiting partner or cohabiting partner
  • Income from compelled to support, who may be his children, sons-in-law, daughters-in-law.

Please note

The grandchild is exempt from the maintenance obligation in the event of an ASH application on behalf of one of his grandparents. This exemption extends to the descendants of this grandchild.

The HSA paid may cover some or all of the accommodation costs charged to the elderly person.

The ASH can also finance the addiction rate for the elderly person housed in Ehpad: titleContent or in USLD: titleContent.

In general, the amount of the ASH allows to leave the elderly at least 10% of his income per month, and in no case less than €125 per month.

When her spouse, partner of Civil partnerships: titleContent or cohabiting partner or cohabiting partner has stayed at home, the amount of the ASH allows to leave at the disposal of this person at least €1,043.59 per month.

In the event of a decline in the income of the elderly person or his or her maintenance obligations, it is possible to send a request for revision of the amount of the ASH by simple letter to the department.

Who shall I contact

During the lifetime of the elderly person

The department may recover the sums paid under the following conditions:

  • If the financial situation of the elderly person improves (e.g. in the case of inheritance)
  • Or on the donation made by the elderly person within 10 years before or after the ASH application.

On the death of the elderly person

The department can recover the sums paid on the portion of the net assets of the estate of the elderly person, that is to say on the assets transmitted by the elderly person to his heirs.

1. Making a prior appeal

If the request of ASH is refused, you can make a prior appeal to the president of the departmental council.

To do this, you must write a letter explaining the reasons for your challenge. You must attach ASH's refusal decision. You can add supporting documents that you think are useful.

You can send all these documents by simple mail to the president of the departmental council, or drop them at the reception of the services of the department.

The president of the departmental council has 2 months to respond.

2. Appeals to the Administrative Tribunal

If the response of the president of the departmental council does not suit you, you can appeal to the administrative court within 2 months.

To do this, you must write a letter and attach the response of the president of the departmental council to your prior appeal.

You can send these documents by mail, or deposit it at the reception of the administrative court.

Who shall I contact

At a family friendly

To receive the HSA, the elderly person must meet the following conditions:

  • She must be over 65 years of age (or over 60 if she is found unfit for work)
  • She must reside in France on a stable and regular basis. If she is a foreign national, she must also have a valid residence permit.
  • It must be housed in a welcoming family approved by the department
  • His income must be less than the amount of accommodation costs charged by the family host.

In order for the accommodation costs to be covered from the date of signing of the reception contract with the family host, the ASH application must be made within 2 months of that date.

It is therefore recommended to apply for ASH at the same time as the admission procedures for family care.

The department's departments set the amount of the ASH taking into account the income of the following persons:

  • Income of the elderly (except for the combatant recognition allowance, and pensions attached to honors, such as the Legion of Honor)
  • Income from the person with whom the elderly person lives as a couple
  • Income from compelled to support, who may be his children, sons-in-law, daughters-in-law.

Please note
