What is a family home? Family care allows an elderly and/or disabled person to be accommodated in the home of a family caregiver. The person accommodated pays the family host. It can obtain financial aid, under certain conditions. We present you the regulations to know.
The family caregiver (a single person or a couple) hosts an elderly person or an adult with a disability. In exchange, the person accommodated pays the family host.
The family host must have received a accreditation issued by the services of the department. These services organize the monitoring of the host and the follow-up of the person hosted.
Family care can be temporary or sequential, or part-time or full-time, or permanent.
Warning
The family friendly and the person with whom she lives as a couple shall not not related, up to and including the 4th degree, with the person hosted. The person accommodated must be able-bodied, or have a loss of autonomy compatible with family care, i.e. not be heavily dependent (for example: not need constant care).
The list of approved family caregivers can be obtained by requesting it from the services of the department.
Cesu family welcome
With the agreement of the family host, the person accommodated uses the Cesu family welcome.
The Urssaf service Cesu manages the processing of the declarations, calculates the amount of the contributions and collects the monthly contributions from the bank account of the host person.
To join the Cesu, the host person must use this online service:
Reception contract
The person hosted or his legal representative must sign with the family caregiver a care contract in accordance with a reception contract type regulatory.
The contract must be signed no later than the day of arrival of the person accommodated.
A signed copy of the contract must be sent to the department. If the contract is amended, the change must be reported and the new version of the contract sent to the department.
The contract provides for a personalized reception project, i.e. taking into account the needs of the person being accommodated. It contains in its annex the charter of rights and freedoms of the person hosted.
The reception contract shall indicate in particular the following:
- Duration of the trial period and conditions for amending or terminating the contract with notice period which may not be less than 2 months
- Duration and pace of reception, i.e. permanent, temporary or sequential, full-time or part-time and the period for which it is concluded
- Material obligations of the host (accommodation, catering, maintenance)
- Rights and obligations of the host and the person accommodated
- Obligations of the two parties to take out insurance
- Financial conditions of reception (remuneration and allowances)
- Host's annual leave entitlements and conditions for his replacement
- Social and medico-social follow-up of the person hosted
The cost of hospitality includes the following:
- Remuneration for services rendered (preparation and service of meals, ironing, personal assistance for the performance of certain acts, travel to take the person accommodated to the doctor...))
- Vacation Pay
- Allowances known as particular subjects calculated according to the need for assistance of the person accommodated, related to his disability or loss of autonomy
- Allowance for the provision of accommodation
- Maintenance allowance (water, heating, food, cleaning and hygiene products ...))
The person accommodated pays directly the family host by any means (transfer, bank check ...).)
Remuneration for services rendered
The amount of remuneration for services rendered shall be at least equal to €30.78 gross per day.
This remuneration is supplemented by an allowance for paid leave corresponding to 10% remuneration for services rendered.
Salary for services rendered and paid leave allowance are subject to the payment of social contributions by the person accommodated.

Special hardship allowance
Depending on the level of subjection, i.e. the availability of the family caregiver linked to the health status of the person accommodated, the amount of the daily allowance is between €4.55 and €17.97.
Special hardship allowances are subject to the payment of social security contributions by the person accommodated.
Allowance for the provision of accommodation
The accommodation allowance corresponds to the cost of occupancy of the accommodation. It shall be fixed in accordance with the following:
- Size and quality of the rooms made available to the person accommodated
- Average rental prices in the surrounding area
The amount of the allowance is negotiated between the person accommodated and the family host.
The department's services have a right of control over the amount of this allowance.
Maintenance allowance
The maintenance allowance is adjustable according to the needs of the person housed (food, hygiene and maintenance products ...).) This allowance shall be between €8.7 and €21.75.

For the welcoming family
The welcoming family can benefit from a tax credit for capital expenditures for seniors and/or persons with disabilities in their main home.
The person accommodated and the family host must first seek an amicable agreement.
If they fail, they must bring the matter before the court the place of residence of the family host.
