      Warning

Some specific rules apply to Mayotte.

You can use a simulator to find out if you are entitled to the AAH:

Estimate your entitlement to the Disabled Adult Allowance (DAA)

You have to meet certain criteria of incapacity, of age, residence and resources to collect the AAH.

      Disability rate

You must have a certain disability rate determined by the Disability Rights Commission (CDAPH). This rate is set according to a scale guide for the assessment of disabilities and disabilities of persons with disabilities.

This rate must be at least 80%. However, it may be 50% à 79% if you have a substantial restriction and sustainable access to employment.

The restriction is substantial when you encounter significant difficulties in accessing a job that cannot be compensated by specific accommodation measures such as an adapted job.

The restriction shall be of a lasting nature provided that it is of a foreseeable duration of at least 1 year from the date of submission of the AAH application.

      Age

You must have at least 20 years.

However, you may have at least 16 years if you are no longer considered to responsibility of your parents for the allocation of family benefits. This is the case, for example, if you have left the family home.

      You are French

You can perceive the AAH if you reside in Metropolitan France or in the departments or local authorities following:

      • Guadeloupe
      • French Guiana
      • Martinique
      • Mayotte
      • The Meeting
      • Saint Bartholomew's
      • Saint Martin
      • Saint Pierre and Miquelon.

      You are European

You can collect the AAH if you live in France for more than 3 months. Compliance with this duration is not not required if you exercise a professional activity.

      You are of another nationality

You can collect the AAH if you live in France for at least 3 months. Compliance with this duration is not not required if you exercise a professional activity.

You must also be in regular situation, i.e. have a residence permit in course of validity or a renewal application receipt a residence permit.

      Resources

The AAH is assigned under resource condition.

The resources taken into account are those shown in the line Categorical net income your 2024 tax assessment (for a 2026 HAA application).

Some income is partially taken into account for the calculation of resources. These are the following revenues:

      • Income from commercial, craft, liberal or agricultural activities
      • Salaries and wages, pensions, life annuities free of charge and remuneration of managers and partners of certain businesses
      • Guaranteed remuneration paid in the event of work in an establishment or work assistance service (Ésat).

On the other hand, land income, that is to say, the rents levied for a dwelling put up for rent, are taken into account in full for the calculation of resources.

Since the 1er October 2023, the amount of the AAH is no longer calculated from your cumulative resources with those of the person with whom you live as a couple. The amount of the AAH is calculated solely from your resources (we are talking about deconjugalization).

HoweverHowever, this change in calculation method is only made if it is more advantageous for you. If not, the combination of your resources and those of the person with whom you live as a couple continues to apply (this is called conjugalization).

It is your Caf or MSA that automatically evaluates and applies the most advantageous calculation method for you. You don't have to do that.

      FYI

As soon as the conjugated calculation no longer benefits you, your AAH is calculated in a deconjugalized way. This calculation is automatic and definitive.

      Please note

One procedure for the recognition of the status of disabled worker (RQTH) is systematically engaged when examining an AAH application.

The MDPH's Commission on the Rights and Autonomy of Persons with Disabilities (CDAPH) is examining the application.

His response comes in a delay of 4 months.

The absence of response of CDAPH for more than 4 months is implied rejection decision.

Yes, the decision of the CDAPH to refuse may be the subject of a compulsory prior administrative appeal (Rapo) with the MDPH. This remedy must be exercised before any appeal to the court.

The RAPO must be filed within 2 months from the receipt of the contested decision. This decision must be attached to your appeal.

The absence of a response from the CDAPH for more than 2 months constitutes an implicit rejection decision.

Based on that decision, explicit or implicit, you have 2 months to appeal to the court of law the location of your residence.
