Disability: increase for independent living (MVA)

You perceive the Disabled Adult Allowance (DAA) or the Supplementary Disability Allowance (Asi) ? You can get the Independent Living Mark-up (AVM). This aid allows to coping with everyday expenses (e.g. groceries, bills) when living in self-contained accommodation. We're taking stock of the regulations.
You must complete the set of conditions following:
- Perceive the AAH at full rate or in addition to a pension, invalidity pension or annuity, or perceive Asia at full rate or in addition to a pension, invalidity pension or annuity
- Have a permanent disability rate of at least 80% determined by the Commission on the Rights for the Autonomy of Persons with Disabilities (CDAPH). This rate is set according to a scale guide for the assessment of disabilities and disabilities of persons with disabilities.
- Living in self-contained housing, i.e. personal housing. If you are hosted by an individual at his home, the accommodation is considered independent only if it is the accommodation of the person with whom you live as a couple.
- Perceive personal housing assistance (APL or ALF or ALS)
- Do not receive income from work.
The process to apply for the MVA differs depending on what you perceive the AAH or Asia :
You perceive the AAH
You have no no steps to take.
The MVA completes the AAH.
You receive the MVA at the same time as the AAH if you meet the MVA award conditions.
You perceive Asia
You must apply for the MVA from the departmental house for disabled people (MDPH) of your department.
The request can be made online through an online service, if the MDPH of your residence offers it:
MDPH (AAH, PCH, admission to Ésat, accommodation...) and renewal
You can also make your request by post through a form:
Application or renewal of disability benefits (AEEH, AAH, PCH, CMI, accommodation, Ésat...)
You must reach supporting documents mentioned during your online application or on the form.
The documents must be sent (or scanned if you apply online) to the MDPH of your place of residence.
The Commission on the Rights and Autonomy of Persons with Disabilities (CDAPH) of the MDPH: titleContent instructs the request.
His response comes in a delay of 4 months.
The absence of response of CDAPH for more than 4 months is implied rejection decision.
Yes, the decision of the CDAPH to refuse may be the subject of a compulsory prior administrative appeal (Rapo) with the MDPH: titleContent. This remedy must be exercised before any appeal to the court.
The RAPO must be filed within 2 months from the receipt of the contested decision. This decision must be attached to your appeal.
The absence of a response from the CDAPH for more than 2 months constitutes an implicit rejection decision.
Based on that decision, explicit or implicit, you have 2 months to appeal to the court of law the location of your residence.
The amount of the MVA is €104.77 per month.
Yes, the MVA is paid until 60e day of hospitalization. Beyond that, it ceases to be paid.
Payment of the MVA automatically resume from 1er the day of the month following the month in which you are no longer hospitalized.
Yes, the MVA is paid until 60e day accommodation in social or medico-social institutions (e.g. specialized foster home). Beyond that, it ceases to be paid.
Payment of the MVA automatically resume from 1er the day of the month following the month in which you are no longer hosted.
Yes, the MVA is paid until 60e day of imprisonment. Beyond that, it ceases to be paid.
Payment of the MVA automatically resume from 1er the day of the month following the month in which you are no longer incarcerated.
AAH articulation, professional activity and pension rights
Article 254 of the Finance Law for 2024 allows persons who receive the Disabled Adult Allowance (DAA) to continue to receive this allowance if they decide to continue their professional activity after their age of entitlement to retirement. This measure will come into force on a date to be fixed by order in council.
