What is Recognition of Disabled Worker (RQTH)?

The recognition of the status of disabled worker (RQTH) is an administrative decision which entitles to a set of measures designed to promote the retention in employment or access to a new job. You are concerned if your chances of obtaining or maintaining your job are reduced due to the degradation of at least one physical, sensory, mental or psychological function.
The RQTH is entitled to a set of measures to access, maintain or consider a new job.
If you have a job in the private or public sector, the RQTH can provide access to adjustments to your conditions or workstation, such as:
- Adjusted working hours
- An adaptation of the station with specific equipment (ergonomic chair, adapted telephone, specialized software, ...).
If you are in job search, the RQTH provides access to several aids and devices, including:
- Devices dedicated to professional integration (e.g. accompanied use device, rehabilitation courses, apprenticeship contract, organization of civil service competitions or specific contractual recruitment)
- Consideration of the employment obligation of disabled workers (OETH).

The RQTH is not not required for work or training. It can, however, facilitate the conditions of your employment. The declaration of the RQTH to the employer is not mandatory. However, if you choose to inform your employer, they can make the necessary adjustments to adapt your workstation to your needs.
To obtain the RQTH, you must respect the 2 conditions following:
- Your chances of getting or keeping your job are reduced by the degradation of at least one physical, sensory, mental or psychic function
- You are over the age of 16 (or even 15 if you are allowed to start an apprenticeship).
For the elderly of 15 to 20 years, the following situations are RQTH:
- The allocation of the child-rearing allowance for disabled children (AEEH)
- The allocation of the disability compensation benefit (PCH)
- The establishment of a personalized schooling project (PPS)
- Orientation to a establishment or a service of accompaniment through work (Ésat) or to a Vocational Rehabilitation Facility or Service (VRS).
RQTH's request is a strictly personal approach. It must be made directly by the person concerned, or, if necessary, by his legal representative. For example, the employer cannot make the application in the person's place.
The process differs depending on whether you are making a parallel request to collect or renew the Disabled Adult Allowance (DAA) :

1st AAH application or renewal application
An RQTH procedure is systematically initiated. So you don't have to apply to get the RQTH.
In the absence of an AAH request
You must apply for RQTH with the departmental house of disabled people (MDPH) of your department.
The request can be made online through an online service, if the MDPH of your residence offers it:
MDPH (AAH, PCH, admission to Ésat, accommodation...) and renewal
You can also make your request by post through a form:
Application or renewal of disability benefits (AAH, PCH, CMI, accommodation...)
You must reach supporting documents mentioned during your online application or on the form.
The documents must be sent (or scanned if you apply online) to the MDPH of your place of residence.
It is the Commission for the Rights and Autonomy of Persons with Disabilities (CDAPH) of the MDPH that decides whether to grant you the RQTH.
Its decision shall be delivered within 4 months.
The absence of response of CDAPH for more than 4 months is implied rejection decision.

When the RQTH is granted, you receive a letter stating that you are a disabled worker recognized by the CDAPH.
This letter is also accompanied by an orientation towards the labor market in ordinary environment or to a establishment or service of assistance through labor (Ésat) or to a vocational rehabilitation center.
Yes, a decision to refuse by the CDAPH may be the subject of a compulsory prior administrative appeal (Rapo) with the MDPH. This remedy must be exercised before any appeal to the court.
The RAPO must be filed within 2 months from the receipt of the contested decision. This decision must be attached to your appeal.
The absence of a response from the CDAPH for more than 2 months constitutes an implicit rejection decision.
Based on that decision, explicit or implicit, you have 2 months to appeal to the administrative tribunal the location of your residence.
The RQTH is awarded for a period ranging from 1 to 10 years. The RQTH is renewable.
However, it may be awarded for life if your disability cannot develop favorably.
The letter from the CDAPH granting you the RQTH specifies its duration of allocation (or the absence of limitation of duration).
Renewal is not not automatic. It must be requested on the paper form or directly online (as for the initial application of RQTH).
When the RQTH is not granted for life, it is necessary to apply for its renewal 4 months before the end date of the allocation.

Your request extends the RQTH until the decision of the CDAPH concerning its renewal is rendered, to avoid any interruption of your rights.
No, the RQTH shall not alter the salary, remuneration or bonuses provided for in the employment contract.
It does not entail a change of contract, which continues to apply in all its provisions.
Please note
In the event of dismissal, the notice period is doubled compared to the usual one, without being able to exceed 3 months.
NoHowever, the RQTH, on its own, does not give rise to the right to early retirement. Access to this device depends on the assessment of the disability, in particular with regard to the recognized level of disability.
