Do I need a dated statement to sell a condominium unit?

Yes, if you want to sell your condominium, you must give the buyer a dated statement. This document specifies the financial situation of the condominium lot. The dated statement indicates the amounts you owe to the syndicate of co-owners and vice versa the amounts that the latter may owe you. In addition, it allows the purchaser to assess the condominium expenses related to his future housing and to anticipate the calls for funds of the syndicate of co-owners. We're taking a look at the regulations.

Only the trustee can establish the dated status. He forwards it to the notary.

The dated status must be requested at trustee by the notary responsible for drafting thedeed of sale or by the seller.

The dated statement consists of 3 parts.

1Amounts owed by the seller to the syndicate of co-owners

  • Provisions due from provisional budget
  • Provisions payable for expenditure not included in the budget estimates (e.g. for works other than maintenance)
  • Amount of unpaid charges on past financial years
  • Works payments per annuity obtained by the seller to finance its share of upgrading works to which it had objected: the amounts are immediately due when the lot is sold
  • Cash advances payable
  • Amount of thegroup loan signed on behalf of the condominium and the remaining due dates by the seller
  • Amount paid by the bond if the seller has not repaid the loan or paid its contribution

The notary or the seller shall inform the creditors registered.

2Amounts owed by the syndicate of co-owners to the seller

  • Cash advances or borrowing of the syndicate of co-owners to the co-owner seller
  • Provisions for periods after the current period and made due following a formal notice for unpaid provisions of the provisional budget

3Amounts to be borne by the purchaser

In the annex, the liquidator shall indicate the following information:

  • Sum of condominium expenses and works other than those for maintenance corresponding to the batch for the last 2 years
  • Subject matter and status of any legal proceedings in progress in the condominium (unpaid charges for example).

Please note

All this information is given as an indication pending the closing of the accounts of the condominium.

The cost of the dated report is limited to €380 TTC: titleContent maximum.

It must be provided for in the trustee's contract under the heading "Costs and fees payable only to co-owners" and approved by thegeneral meeting of co-owners.

The trustee must invoice the seller for the preparation of the dated statement.

You can dispute the cost of the dated report when it exceeds €380 TTC: titleContent, even in the case of the sale of several condominium lots at the same time.

Sale of several condominium lots at once

The trustee cannot multiply the invoices in case of simultaneous sale of several condominium lots (for example sale of a dwelling and a parking space). If the trustee accumulates invoices and exceeds €380 TTC: titleContent, you can challenge them. You can use the following letter template:
