Lump-sum fine for driving without a license

You wonder if the offense driving without a license may be punished by a flat-rate fine instead of a fine imposed at the end of a criminal trial? We tell you what you need to know.
If you drive a motor vehicle, you must have the license for the category of this vehicle. For example, the permit B for a car.
Driving a motor vehicle without a license, or without a license corresponding to the category of that vehicle, is a misdemeanor. For example, if you drive a motorcycle under the permit A while you only have the permit B, or if you drive while your license has been invalidated (zero point balance). However, the offense of driving without a license does not concern the driving of a moped or a light motor quadricycle.
The driving without a license is punished by a maximum of 1 year in prison and a fine of up to €15,000. A report shall be drawn up and sent to public prosecutor who decides on the continuation of the legal proceedings. Your vehicle can be immobilized and impounded.
You also risk additional penalties following:
- Confiscation of the vehicle if you own it
- Sentence of community service
- Sentence of fine days
- Prohibition to drive certain vehicles, including vehicles without a license, for a maximum period of 5 years
- Obligation to perform, at your expense, a road safety awareness course
However, a procedure of a flat-rate fine can be implemented if the following 4 conditions are met :
- The offense of driving without a license has been found byelectronic record after interception of your vehicle
- You commit the offense Driving license without license for the 1era times
- You're an adult
- If you have committed several offenses, they are all punishable by a lump sum fine.
Following the establishment of the offense, a infringement notice, a payment notice and one waiver application form, are sent to your home by letter. Your vehicle can be immobilized and impounded.
Driving a vehicle without having the license corresponding to the category of that vehicle, while using a false or falsified licenseshall be punished by a maximum of 5 years' imprisonment and €75,000 of a fine.

You also risk additional penalties following:
- Confiscation the vehicle if you own it. The court may, however, refrain from imposing that penalty by a specially reasoned decision
- Sentence of community service
- Sentence of fine days
- Prohibition to drive certain vehicles, including vehicles without a license, for a maximum period of 5 years
- Obligation to perform, at your expense, a road safety awareness course
- Withdrawal of civil and family rights. This withdrawal leads in particular to ineligibility.
- Prohibition on exercising certain professions and running a company
- Exclusion from public procurement
- If you are a foreigner, inadmissibility, permanent or 10 years maximum.
The amount of the flat-rate fine is set to €800.
The amount of the flat-rate fine is fixed at €4,000 for a legal person.
You have to pay the flat-rate fine in a 45 days (60 days in the event of electronic payment by credit card of the infringement notice). The deadline is short either from the finding of the infringement or, if notice is sent, from this shipment.
The amount of the flat-rate fine is minus in the following 2 cases:
- You pay immediately the fine in the hands of the officer. In this case, you will receive a notice of offense with the words “fine paid” at your home.
- You pay within 15 days (30 days in case of telepayment by credit card of the infringement notice). The payment period shall run from the time when the infringement is found to have occurred or, if a notice is sent, from that time.

The amount of the flat-rate fine is increased if you don't pay the flat-rate fine within a period of 45 days (60 days in the event of electronic payment by credit card of the infringement notice). The period for payment shall run either from the finding of the infringement or, if a notice is sent, from that sending. You receive a notices inviting you to pay the amount plus the fine.
Amount of the increased fine
The amount of the lump sum fine increased is set to €1,600.

Deadline for paying the increased fine
You must pay the increased fine in a 30 days from the date of sending the infringement notice (45 days in the event of electronic payment by credit card of the opinion).
If you meet this deadline, the amount due is decreased by 20%.
If you do not meet this deadline, the Treasury may initiate a mutual agreement or judicial procedure to obtain payment.
If you have difficulty paying a flat-rate fine increased, you can request a payment term or a graceful discount.
You must send your request to Public Treasury Accounting Officer. Your request must be reasoned : Explain why you need a time to pay or a discount. Join them supporting documents of your expenses and resources in particular.
If he considers your request justified, the Public Treasury Accountant can grant you either a payment period, or a graceful discount partial or total (if necessary by applying a 20 % decrease).

Please note
Payment of the fine means that you acknowledge the offense. You will no longer be able to challenge the offense notice.
Reminder
You cannot challenge a notice of violation if you have paid the fine.

You also have to pay a logging equal to the amount of the flat-rate fine. The procedure for paying the deposit is identical to that for paying the lump sum fine. However, use the consignment card attached to the waiver application form, not the payment card.
