Voluntary Severance Pay in the Hospital Public Service (PHF)

Are you a public servant or contractor in the hospital public service (FPH) and are you resigning as a result of the restructuring or abolition of your position? You can, under certain conditions, benefit from a voluntary severance payment. We present you this device.
You can receive a voluntary severance payment when you choose to resign due to the reorganization of your department or institution resulting in the termination of your employment.
If your job is eliminated, you benefit from various mechanisms allowing you to find a new job corresponding to your grade or under another body or framework of jobs of at least equivalent level.
But you can also choose to resign. You can then receive a voluntary severance payment.
Voluntary severance pay may be granted to you if you are in one the following situations:
- You are a civil servant, trainee or holder
- You are a contractor in CDD: titleContent or in CDI: titleContent and your recruitment is justified by the nature of your duties or the needs of the service. This is the case if your contract is for 1er paragraph of Article 9 of Law No. 86-33 or Article L332-15 of the General Civil Service Code.
You must meet the following 3 conditions:
- Be on duty when reorganizing the service. You are not considered to be on duty if you are on standby, unpaid leave or parental leave.
- Prove at least 5 years of actual services in one or more jobs in one or more hospitals
- Do not fill in the insurance term conditions to benefit from a full-rate pension within 2 years of the date of your resignation or be more than 2 years from the date of your age limit.
Reminder
You are active if you are on paid sick leave.
You must send a request for resignation and payment of the voluntary severance allowance to your head of institution.
Voluntary severance pay is not a right. It is paid to you on condition that your resignation is accepted by your head teacher. He must answer you within one month of your request.
The head of the institution examines your request for resignation according to the needs of the service and after an interview with you on your motivations.
Having developed a personal project may be an advantage over other claims, but it does not guarantee the payment of compensation.
Before accepting the resignation, your superintendent must ensure that you meet all the conditions required to receive voluntary severance pay.
If your resignation and claim for compensation is refused, you can enter the CAP: titleContent, whether you are a civil servant or a contractor.
The amount of voluntary severance pay depends on your seniority and gross salary on the day before you resign if you are a civil servant (or gross salary if you are a contract employee).

However, the gross amount of the allowance may not exceed €45,734.71.
Voluntary severance pay is subject to the following contributions:
- Additional Retreat (RAFP) if you are a civil servant (or pension contribution to the general social security scheme if you are a contractor)
- CSG and CRDS.
It is not taxable.
If you are re-recruited as a public servant or contractor within 5 years of your resignation, you must reimburse your voluntary severance pay.
This applies whether you are recruited into the state, territorial or hospital civil service.
You can collect unemployment benefits if you meet the conditions to benefit from it.
