From a certain age, called age limitHowever, you can no longer be retained in office and you are compulsorily retired. However, in some situations, you can continue your professional activity beyond the age limit. Public servant

The age limit is different depending on whether you are a public servant active category or sedentary.

What is the age limit for a sedentary civil servant?

The age limit is set at 67 years.

The removal of the executives is pronounced the day after the day of 67e birthday.

However, in some cases, you can apply for permission to continue working beyond the age of 67.

In what cases can a non-permanent civil servant work beyond the age limit?

You may be allowed to continue working beyond the age of 67 and up to 70 years maximum, mainly in the following cases:

You can request permission to be held in office until the age of 70.

If your employer administration refuses you this authorization, it must state reasons for refusal.

Incomplete career

You can apply to work beyond the age of 67 if you do not have enough liquid quarters to benefit from a pension at the maximum rate of 75% of your last gross index treatment.

Liquidable quarters are the quarters actually paid in the retirement pension.

The extension of activity for incomplete career is yours granted after application of the possibility of lowering the age limit for children where you can benefit from these possibilities of lowering the age limit for children.

The cumulative benefit of the extensions of activity can not lead to keep you in activity beyond 70 years.

Retention periods for incomplete careers are taken into account when calculating your retirement insurance period and when calculating your retirement pension.

You must send an written request deferral of the age limit to your employer administration At least 6 months before your 67e birthday.

Your request must state the reason for requesting the postponement and be accompanied by the relevant supporting documents.

Your employer administration must inform you of its decision at least 3 months before your 67e birthday.

Staff member who is the parent of one or more children

You can apply to continue your professional activity beyond the age of 67 if you find yourself in one of the following situations:

  • You still have one or more dependent children at age 67. You can work, in this case, 1 additional year per child charged without the extension of activity exceeding 3 years in total. The children taken into account are those eligible for family benefits or those entitled to the allowance for adults with disabilities.
  • You were parent of at least 3 children alive at 50 years of age. You can work, in this case, 1 additional year. This decrease in the age limit can be combined with the previous decrease if one of your dependent children at 67 years of age has a disability equal to or greater than 80% or is entitled to the allowance for adults with disabilities.
  • You are a parent, or you raised and cared for, one or more children died for France. You can work in this case 1 additional year per child deceased.

Your employer administration cannot refuse you permission to continue your activity on any of these grounds.

To be kept in business, however, you must physically fit to continue to work.

These possibilities of lowering the age limit for children can be combined with the possibility of applying to work up to the age of 70.

The cumulative benefit of these extensions of activity cannot lead you to remain in activity beyond 70 years.

However, in some cases, you may request permission to continue working beyond the age limit applicable to you, unless you are an air traffic controller.

The age limit for air traffic control engineers is set at 59 years old, with no possibility of deferral.

FYI  

If you are integrated, as a result of a statutory reform, into a body or framework of sedentary category jobs (with an age limit of 67), you can apply to retain the benefit of the age limit of your former active category job, if you have completed at least 15 years of service in this active category job.

Work permit up to 67 years

You can apply to remain in business until age 67.

This extension of activity up to 67 years of age may be granted to you after application of the possibilities of extension of the age limit which may be granted for the following reasons:

  • Extension of activity one year per dependent child if you have one or more dependent children when you reach the age limit applicable to you without the extension of activity exceeding 3 years in total
  • Extension of activity one year if you were a parent of at least 3 children alive at age 50
  • Activity extension for incomplete career.

This extension of activity is granted subject to your physical fitness to continue to work.

You cannot request an extension of the age limit if you are on long-term or long-term leave or part-time for therapeutic reasons.

And if, during your extended period of activity up to age 67, your state of health justifies your placement on long-term sick leave or part-time leave for therapeutic reasons or your reclassification for physical incapacity, your extended activity is terminated.

You are then expunged from the management and retired.

Retention periods up to the age of 67 are taken into account in calculating your retirement insurance period and in calculating your retirement pension.

You must formulate your request for extension of activity to your employer's administration at least 6 months the age limit applicable to you.

Your employer administration acknowledges receipt.

Your application must be accompanied by a medical certificate established by a licensed medical practitioner who can demonstrate your fitness for the position you hold.

The doctor can ask your employer administration for any useful information about your working conditions and the issues related to your position. You also receive all the documents sent to the doctor.

You, and your employer administration, can challenge the findings of the medical certificate before the medical board. If your employer administration refers the matter to the medical board, it will inform you.

Your employer's administration informs you of its decision at least 3 months before the age limit applicable to you.

In failure to respond to your request for more than 3 months, your administration is an employer implicitly considered as having given its consent at your request. You can ask your employer administration to issue you a certificate of authorization to continue your activity.

When the medical council is seized, your employer's administration makes its decision within one month of the medical opinion.

As long as the administration has not made its decision, you remain in office.

If you become physically unfit for your duties during the extension period, the extension period shall be terminated.

You can reverse your decision and apply for retirement before age 67. You must submit your application at least 6 months before the date on which you wish to cease your activity.

Contractual

The age limit is set at 67 years.

The cancelation of the staff is pronounced the day after the day of 67e birthday.

If you are a preventive doctor or a contract labor doctor, the age limit is 73 years.

The children taken into account are those eligible for family benefits or those entitled to the allowance for adults with disabilities.
