What city planning authorization to deposit to settle an annex in his garden?
Verified 13 November 2025 - Public Service / Directorate of Legal and Administrative Information (Prime Minister)
To settle a annex permanent or temporary in your garden, you sometimes have to file a preliminary declaration of work or an application for a building permit (PC). In some cases, you don't need it. THEauthorization to be deposited depends on the location of the land (in an urban area of a MORE: titleContent or not, in protected area or not), the permanent or temporary nature of your facility and its surface. We present the regulations to you.
Warning
Different regulations apply for a caravan, one mobile home, a garden greenhouse, a swimming pool or a construction site shack.
Your schedule is permanent if it stays in place for more than 3 months on your land. For example, it may be a garden shed , of a lean or a carport.
Your schedule is provisional if it remains in place for a maximum of 3 months on your land. It must also be intended for temporary occupation. For example, it can be an arbor, a swing, a Balinese bed or a light structure of playground (gantry, slide, swing, trampoline...).
Warning
The 3-month period is extended to 15 days if your land is located in a classified site or pending classification, within the perimeter of remarkable heritage site, in the surroundings of a historic monument or within a perimeter defined by a deliberation of the municipal council. You can obtain this information from your town hall.

Permanent Annex
In any case, you must consult the MORE: titleContent of your commune. It can provide rules on building materials and the placement of your annex in relation to neighboring properties. To know these rules, you must contact the city planning department of your town hall.
If the PLU does not provide for specific rules, you must settle your annex either on the boundary of your property or at least 3 meters from it.
In addition, if your annex leads to a view of your neighbor, you must also respect distance rules in relation to the limits of his property.
You need to check if your land is located in a protected area. You can obtain this information from your town hall.
