Is a temporary worker entitled to leave for a career transition project?

Yes, if you are a temporary worker (often called acting), you can benefit, under conditions, from a leave for a career transition project (PTP), former individual training leave (Cif). Here we present the regulations to know.

The career transition project (PTP), or Transitional CPF, allows you to be absent to follow a certifying training allowing to change profession or profession.

It replaces the individual training leave (Cif).

You benefit from a specific leave when you complete this training in whole or in part during working time.

The requested training does not need to be related to your activity.

These seniority requirements vary depending on your situation:

General case

To obtain a leave related to a TPP, you must meet 2 conditions cumulative :

  • 1,600 hours of acting service in the last 18 months
  • Of these 1,600 hours, 600 must have been completed in the temporary work company or group of temporary work undertakings where you are applying.

This seniority condition must be met no later than the day from your departure in training.

If you are in DTA: titleContent, periods without the performance of a mission shall be taken into account for the calculation of seniority.

Beneficiary of the employment obligation

There is no seniority requirement if you have the obligation to work, that is, if you find yourself in particular in one of the following 7 situations:

Licensed

There is no seniority requirement if you meet the 2 conditions following:

  • You have changed jobs as a result of dismissal for economic reasons or incapacity
  • You have not undergone any training between your dismissal and your re-employment.

Absence from work in the last 24 months

There is no seniority requirement if you have known within 24 months (2 years) before your application training:

  • Or absence from work resulting from an occupational disease
  • An absence from work of at least 6 months, consecutive or not, resulting from an illness, illness or non-occupational accident.

Your leave request must include the information following:

  • Start date of the training action
  • Designation and duration of this training
  • Name of the organization responsible for it
  • Title and date of the relevant examination.

You must obtain written leave of absence from your temporary work company.

A minimum deadline must also be respected.

It varies depending on the length of leave:

Leave of less than 6 months or part-time training

The request must be made to minimum 60 days before the beginning of the leave.

Leave of 6 months or more

Part-time training

The request must be made at least 60 days before the beginning of the leave.

Full-time training

The request must be made at least 120 days before the beginning of the leave.

The temporary work company must respond within 30 days.

They can accept the training, but they can also refuse or postpone it.

FYI  

If this 30-day period is exceeded, the authorization is presumed to be granted.

Training is denied

The company of temporary work may refuse the request only if you do not meet the conditions to make an application (the request is not precise enough or the deadline for making this request is not respected).

Training is delayed

The company of temporary work may defer leave of absence only if the date of the request and the date of departure on leave occur during the same mission.

However, the postponement of the authorization is impossible in any of the following cases:

  • The aim of the training is to obtain a qualification in a different industry
  • The training lasts more than 1200 hours.

You must apply for financial support for the training costs. This request is made to the regional interprofessional joint commission (CPIR), also known as Transitions Pro association. The competent ICRP shall be that of the place of principal residence or the place of work.

This request is accompanied by a number of documents (examples: leave of absence issued by your employer if the training takes place in whole or in part during working time).

This process is carried out:

  • During your contract or no later than 4 months after the end of your last contract (date of application)
  • And provided that the training begins at later than 6 months after the end of your contract.

The panel assesses whether the proposed training is possible under a TPP.

Example :

Your contract ends on March 31. You can apply for funding until July 31 if the training starts no later than 6 months after the end of the contract, i.e. end of September.

Check with your regional commission (Transitions Pro association) that it has not adopted any other rules.

In practiceHowever, you may be asked to submit the complete file no later than 3 months before the start of the training.

Your regional commission takes charge all or part costs related to the educational cost.

The management of all or part of the ancillary costs (transport, meals, accommodation) by the CPIR is possible.

During working time

Your remuneration during the TPP varies depending on your reference salary.

The latter is calculated on the basis of the average salaries received during the last 600 hours of assignment on behalf of the temporary company of work in which you have requested to be absent.

The situation varies according to whether the average reference salary is above or not 2 Smic:

Average reference salary above 2 Smic

Remuneration depends on the length of the transition leave:

Leave not exceeding 1 year

If the employee's average reference salary (SR) is greater than €3,646.07, the remuneration shall be equal to 90% SR, where the duration of the work transition leave does not exceed 1 year or 1 200 hours for part-time or fragmented training.

Leave of more than 1 year

If the employee's average reference salary (SR) is greater than €3,646.07, the remuneration shall be equal to:

  • 90% SR for 1re year of training or for the first 1,200 hours of training, where the duration of the TPP is greater than 1 year or 1,200 hours for a fragmented or part-time training
  • 60% SR for subsequent years or from 1201e time,

Beyond one year, the amount of remuneration received may not be less than an amount equal to €3,646.07.

Average reference salary less than or equal to 2 Smic

When the average reference salary of the employee is less than or equal to €3,646.07, the remuneration received under the TPP shall be equal to 100% the average reference salary.

Totally excluding working time

If the training takes place in full excluding working time, the Regional Inter-branch Joint Committee (CPIR) shall decide only on the reimbursement of teaching costs.

There is therefore no request for payment of remuneration.

The duration of the leave is equivalent to a mission period for the calculation of seniority and leave entitlements.

You hold a training assignment contract.

You retain your social protection rights.

Warning  

If the training takes place out of working time, you can apply to the Regional Inter-branch Joint Committee (CPIR) to ensure that you have social protection.

3 months before the end of the training, the employer informs you that at the end of the training you can:

  • Finding your job
  • Or, if not, an equivalent position.

The remuneration must be at least equivalent.

This information from the employer is provided by letter RAR: titleContent or by hand-delivered letter against discharge.

In the notification letter, the employer states that you have one month from receipt of this letter to inform the employer of your decision.

Without a response within this one-month period, you are considered to have agreed to return to the company upon completion of the training.

If you have already benefited from a TPP, you have to wait a certain time, says deductible periodbefore being eligible for another TPP.

This period is expressed in months. It is equal to 10 times the duration of the career transition project previously carried out, expressed in months.

This deductible period may not be less than 6 months (floor period) and it may not be more than 6 years (ceiling period).

Example :

You have received a TPP for a period of 9 months. Thus, this deductible period is 90 months (9*10) or 7.5 years. This figure is above the 6-year ceiling. The time limit is therefore 6 years.
