When the employee's employment contract ends, the employer shall be available in the company end-of-contract documents. In particular, the employer shall provide the employee with employer attestation, said attestation France Work. This document allows the employee to to assert your rights to unemployment benefits. The employer issues a France Travail certificate to the employee at the end of the employment contract.

Yes, the employer holds available to the employee, on company premises, a printed copy of the France Travail certificate.

The employer did not not the obligation send the certificate to the employee by post. The document is querulous.

The France Travail certificate allows the employee to assert his rights to unemployment benefit, subject to conditions.

The France Travail certificate is submitted to the employee, on request and if the employment contract refers to the right to obtain it at the end of the contract, in the following cases:

The employer is available from the employee the France Travail attestation to the end date of the employment contract, i.e. at the end of the notice period even if he is not working.

Please note

In case of waiver of notice, the France Travail certificate may be available to the employee on the effective date of departure of the company, if the last pay is established.

If the France Travail certificate contains false or incomplete information, the employee may ask the employer to correct the certificate.

For example, it may be an inaccurate reason for the termination of the employment contract.

If the employer does not rectify the France Travail certificate or sends a new erroneous certificate, the employee may enter the Labor Court (CPH).

It is not possible to download the employer certificate from the internet.

To obtain this certificate, theemployer contact France Travail which delivers the updated version to it.

The employer shall transmit obligatory attestation to France Travail by dematerialization :

The absence of delivery or the late delivery of the France Travail certificate may cause a delay in payment of unemployment benefit (ARE).

If this is the case, the employee can seize the Labor Court (CPH). Of damages and interest may then be paid if the damage is recognized.

Yes. An employer who fails to submit the certificate to France Travail may be ordered by the judge to pay a fine of up to €1,500 if it's a natural person.

This amount may be increased to €3,000  in case of recurrence where provided for in the Regulation.

If the employer is a legal person, the fine may be up to €7,500.
