You have a disability and you cannot engage in a professional activity ? You can be accommodated in a home of life (or occupational home). These homes offer occupational and social activities adapted to your disability situation. We present you the information to know.
The living home (or occupational home) offers adults with disabilities having a certain autonomy various activities adapted to their abilities (e.g. sculpture, painting, gymnastics).
The living home can offer a temporary reception, day or boarding.
Warning
The home of life is intended for people who do not belong to a establishment and work support service (Ésat), nor of a specialized reception house (Mas), or of a nursing home (Fam).
In order to be admitted to a home of life, you must have a incapacity rate of at least 50% and have sufficient autonomy to carry out your daily activities (feed, dress...).
This rate is determined by the Commission for the Rights for the Autonomy of Persons with Disabilities (CDAPH) of the departmental house of persons with disabilities (MDPH) on the occasion of your application for admission.
In addition, you must be of French nationality or a national of a country of the European Economic Area (EEA) (or have a valid residence permit if you are a foreign national).
You must make your application for admission to the MDPH of your department.
The request can be made online through an online service, if the MDPH of your residence offers it:
MDPH (AAH, PCH, admission to Ésat, accommodation...) and renewal
You can also make your request by post through a form:
Application or renewal of disability benefits (AAH, PCH, CMI, accommodation...)
You must reach supporting documents mentioned during your online application or on the form.
The documents must be sent (or scanned if you apply online) to the MDPH of your place of residence.
The MDPH's Commission on the Rights and Autonomy of Persons with Disabilities (CDAPH) is examining the application.
His response comes in a delay of 4 months.
The absence of response of CDAPH for more than 4 months is implied rejection decision.
It is only once you have received a favorable response from the CDAPH that you can apply directly for admission to a living home. The list of these structures is available from your town hall.
Yes, the decision of the CDAPH to refuse may be the subject of a compulsory prior administrative appeal (Rapo) with the MDPH. This remedy must be exercised before any appeal to the court.
The RAPO must be filed within 2 months from the receipt of the contested decision. This decision must be attached to your appeal.
The absence of a response from the CDAPH for more than 2 months constitutes an implicit rejection decision.
Based on that decision, explicit or implicit, you have 2 months to appeal to the court of law the location of your residence.
Your participation in the accommodation costs is determined according to your resources.
Nevertheless, a minimum of income is left at your disposal. This amount must be at least equal to €312.48 per month.
