Disability: nursing home (Fam)
Verified 01 April 2026 - Public Service / Directorate of Legal and Administrative Information (Prime Minister)
You are dependent and need a third person to carry out the acts of everyday life (feed you, dress you...)? You can be accommodated in a nursing home (Fam). The Fam offers permanent accommodation, medical care and life activities. The Fam welcomes people who are less dependent than in specialized care homes (Mas). We present you the information to know.
The nursing home (Fam) offers accommodation and support to adults with severe disabilities to carry out the essential acts of daily life (food, clothing...).
The Fam also offers medical supervision and educational assistance to help maintain or acquire greater autonomy.
FYI
In principle, the Fam welcomes people a little less dependent than the population hosted in specialized reception house (Mas).
To be welcomed in Fam, you must need a third person to perform the daily acts (dress, move...), and medical supervision with constant care.
In addition, you must be of French nationality or a national of the European Economic Area (EEA) (or have a valid residence permit if you are a foreign national).
You must make your request for reception at the departmental house of disabled people (MDPH) of your department.
The request can be made online through an online service, if the MDPH of your residence offers it:
MDPH (AAH, PCH, admission to Ésat, accommodation...) and renewal
You can also make your request by post through a form:
Application or renewal of disability benefits (AAH, PCH, CMI, accommodation...)
You must reach supporting documents mentioned during your online application or on the form.
The documents must be sent (or scanned if you apply online) to the MDPH of your place of residence.
It is only once you have obtained a favorable response from the CDAPH that you can directly apply for admission to a Fam. The list of Mas is available from your town hall.
Who shall I contact
The MDPH's Commission on the Rights and Autonomy of Persons with Disabilities (CDAPH) is examining the application.
His response comes in a delay of 4 months.
The absence of response of CDAPH for more than 4 months is implied rejection decision.
It is only once you have obtained a favorable response from the CDAPH that you can directly apply for admission to a Fam. The list of these structures is available from your town hall.
Yes, the decision of the CDAPH to refuse may be the subject of a compulsory prior administrative appeal (Rapo) with the MDPH. This remedy must be exercised before any appeal to the court.
The RAPO must be filed within 2 months from the receipt of the contested decision. This decision must be attached to your appeal.
The absence of a response from the CDAPH for more than 2 months constitutes an implicit rejection decision.
Based on that decision, explicit or implicit, you have 2 months to appeal to the court of law the location of your residence.
The costs concern accommodation and social support (housing, food, animation) and medical care (nurses, medicines, physiotherapy, medical consultations...).
The costs of accommodation and social support are set by the president of the departmental council. They therefore vary from one department to another. You contribute to these costs according to your resources, but you keep a remains to be lived of at least €312.48 per month.
Medical care is funded by a comprehensive package supported by Social Security, which means that it is not your responsibility.
