The condition of the indoor electricity installation is a diagnosis that assesses the risks that may endanger the safety of people and their property. Rental

The owner who rents a apartment or a detached house of which the installation of electricity has more than 15 years must provide an electricity diagnosis to the future tenant.

Diagnosis should be made by a diagnoser responding to certain criteria, including certification.

Electricity diagnosis is carried out in the private parts of the dwelling and its outbuildingsdownstream of the general apparatus for controlling and protecting the electrical installation specific to each housing, as far as the power supply terminals or as far as the sockets of the sockets.

Electricity diagnostics also include the suitability of fixed equipment for network characteristics and the conditions of their installation with regard to safety requirements.

Electricity diagnostics shall identify the existence and describe, in the light of safety requirements, the characteristics of:

  • A general control and protection apparatus and its accessibility
  • At least one differential device of appropriate sensitivity to the grounding conditions, at the origin of the electrical installation
  • An overcurrent protection device adapted to the section of the conductors, on each circuit
  • An equipotential connection and an electrical installation adapted to the particular conditions of the premises containing a bath or shower.

Electricity diagnostics identify electrical equipment that is unsuitable for use (or presents a risk of direct contact with live elements) and conductors that are not mechanically protected.

The electrical diagnosis must be carried out in accordance with a regulated methodology and model.

Electricity diagnostics must be integrated into the technical diagnostic record (DDT).

It must be given to the future tenant at the time of signing the lease.

Electricity diagnosis must have been carried out since under 6 years old on the date of signature of the lease.

However, a certificate of conformity of the national committee for the safety of electricity users (Consul), usually delivered by the installer, can replace the electrical diagnosis if the certificate has been made for less than 6 years.

The penalties vary depending on the people involved.

Lessor

The landlord may be held liable if he does not transmit the electricity diagnosis or if he provides inaccurate information in the rental announcement, misleading the future tenant.

The lessor may also be fined €1,500 if using an uncertified diagnoser (€3,000 in case of recurrence).

Diagnostic

If the diagnoser makes a mistake by not complying with the regulations to carry out the electrical diagnosis (for example, erroneous diagnosis), the tenant can appeal to the judicial court of the location of the property to request  damages and interest.

In addition, the diagnoser may be fined €1,500 if practicing without certification (€3,000 in case of recurrence).
