Talent card: multi-year residence card of a foreigner in France

You are a foreigner no European and you want to work in France for more than 3 months? You can benefit from a multi-year talent residence card under conditions. The procedure for applying for the card differs depending on whether you are in France or abroad. We present you the information you need to know according to your situation.
FYI
You must apply for a Talent Residence Card if the proposed length of stay is at least 1 year. If the length of stay is less than 1 year, a long-stay visa as a residence permit (VL-TS) mention talent enough.

You can get a card talent - skilled employee if you meet the following 2 conditions:
- Have obtained in France a diploma of Specialized Masters / Master of Science (certified by the Conférence des grandes écoles) or at least equivalent to the master's degree
- Have an employment contract of more than 3 months that provides for an annual gross remuneration equal to or greater than €39,582.
Employee of an innovative company
You can get a card talent - skilled employee if you meet all of the following conditions:
- Be recruited in an innovative young company or a company recognized as innovative by the Ministry of Economy
- Have functions directly related to this company's research and development project
- Have an employment contract that provides for an annual gross remuneration equal to or greater than €39,582.
Employee on assignment
You can get a residence card talent - employee on assignment - exercise of an employee activity if you meet all of the following conditions:
- Be an employee of a company established abroad and come to France to pursue an activity as an employee within the framework of mobility between establishments of the same company or between companies of the same group (intra-group mobility)
- Have a seniority of at least 3 months in the group that employs you
- Have a employment contract with the company that employs you in France
- Receive an annual gross remuneration at least equal to €39,582.

- Social security posting certificate (or sworn certificate of application for registration with the French social security)
- Letter detailing the functions performed and the purpose of the mission to be performed
- Certification of the employer

4Do the process on the internet
You must submit your application on the Internet no earlier than 4 months and no later than 2 months before the end of validity of your residence document (visa, VLS-TS or title):
When you submit your application for a residence permit on the internet, you will immediately receive a dematerialized certificate of deposit.
5Be informed by the prefecture on the validation of the residence card
The prefecture confirms the availability of your residence card and the amount of the tax.
6Buy the tax stamp
If the residence card is assigned to you, you must pay €225 (stamp duty of €25 + tax of €200) by tax stamps.
Proof of payment of stamp duty and tax is requested when the card is handed over.
You can buy the tax stamp on the internet or in a tobacco office.
On the internet
You can purchase your tax stamp using an online service:

Payment is possible with the following bank cards:
- Carte bleue (CB) and e-carte bleue
- Visa
- Mastercard.
However, payment by Paypal or American Express card is not accepted.
The electronic stamp can be issued on 2 supports:
- PDF document with a 2D code that can also be scanned directly from a phone or tablet by the service responsible for receiving your request
- SMS containing the 16-digit identifier of the stamp that will be accepted by the agent responsible for processing your file.
In a tobacco shop
You can buy a tax stamp from a tobacco office, if the business is equipped to be able to edit them.

7Pick up the residence card once it is available
The card is given to you by the prefecture or sub-prefecture of your home.
In most prefectures, you need to make an appointment.

The card is valid for the same period as the employment contract, up to a maximum of 4 years.
Stay of your family
Your spouse and minor children can benefit from the simplified procedure accompanying family and obtain a residence card talent "family" without going through the application for family reunification.
Your spouse and minor children receive a multi-year residence card talent family.
8Dispute in case of refusal
The deadlines for contesting are different depending on whether or not you have received a response from the prefecture:

The prefect's decision is yours notified by reasoned letter (explicit decision). Except in exceptional cases, this refusal shall be accompanied by a obligation to leave French territory (OQTF) determining the country to which you will be sent.
You can form a litigation before the administrative court
Failure of the prefect to reply to your request
If the prefecture has not responded after 4 months, this is an implicit refusal.
You can then file the following appeals within 2 months of this refusal:
- Administrative appeal (ex gratia before the prefect and/or hierarchical redress before the Minister of the Interior),
- And/or litigation before the administrative court.
The talent residence card - European Blue Card - exercise of an employed activity authorizes you to stay in France. It allows you to work. Your employer does not have to apply for a work permit.
The duration of the talent card - EU Blue Card depends on the duration of the employment contract:
- Where the employment contract has a duration of at least 2 years, the card is issued for a duration equal to that of the contract, within the limit of 4 years.
- Where the employment contract has a duration of less than 2 years, the card is issued for a duration equal to that of the contract, increased by 3 months, within the limit of 2 years.

1Check if you meet the conditions
You can get a residence card talent - european blue card - if you are a highly skilled worker.
You must meet the following 3 conditions:
- Have a diploma attesting to at least 3 years of higher education or 5 years of professional experience of comparable level or have acquired, under conditions determined by decree of the Council of State, at least 3 years of relevant professional experience during the 7 years preceding the application
- Have an employment contract of at least 6 months
- Have a gross annual remuneration of at least €59,373.00.
Please note
This card is also granted if you have stayed at least 1 year in another EU countries with a european blue card. You must apply within one month of entering France.
This minimum stay is reduced to 6 months from the 2e mobility within a Member State of the European Union.

- Certificate of payment of social security contributions to the body responsible for their collection (and to the paid leave fund if necessary) provided by your employer
- Proof of your qualifications and experience to hold the position (copy of diplomas and credentials obtained, CVs, work certificates proving professional experience)
- If the activity is regulated : proof that the employer meets the conditions for exercising it (license, prior declaration of intervention to the regional directorate of cultural affairs, etc.)
- Signed copy of the commitment to respect the principles of the Republic

If the prefecture has not replied after 90 days, this is an implicit refusal. This period is 30 days if you already hold an EU Blue Card in another EU Member State.

The talent - medical professions and pharmacy residence card allows you to stay in France and work there under certain conditions. Your employer does not have to apply for a work permit.

- You have a license to practice provided for by the Public Health Code: assignment decision, certificate allowing a temporary practice or authorization to practice

- Justify a real and serious company creation project in France

Innovative economic project
You can get a residence card talent - project leader if you have an innovative economic project recognized by a public body.
You must also have sufficient resources to support yourself and your family, at least equal to €21,621.60
Direct economic investment
You can get a residence card talent - project leader if you meet all of the following conditions:
- Invest through a company that you personally manage or in which you hold at least 30% of capital
- Consider creating or safeguarding employment within 4 years of investment in France
- Investment in tangible or intangible fixed assets in France which must represent at least €300,000.
