What to do in case of difficulties in paying the monthly installments of a mortgage?

If you have temporary difficulties repaying your mortgage, you can take several steps to find a solution. We present them to you.

You can ask the lender (for example, the bank) to give you payment terms.

To send your request, it is recommended to use a means to attest the date of your request. For example, you can send your request by registered mail with acknowledgement of receipt.

The lending agency is not not obliged to accept your request.

You can call on insurance for your home loan (borrower insurance).

Your insurance contract may cover the payment of monthly installments of your credit in certain situations (death, invalidity, incapacity guarantee or job loss guarantee). If this is the case, you will avoid having to pay penalties for unpaid monthly payments. A mortgage contract generally provides for such penalties.

You can request the court to suspend the reimbursement of your mortgage, during a grace period up to 2 years, and without incurring any surcharges or penalties for late payment. The court may grant you this suspension, depending on your situation.

To do so, you must apply to the protection litigation judge, regardless of the amount of your credit.

You must attach to your application documents proving your resources, your expenses, your current reimbursements, as well as the reasons explaining your difficulties to reimburse (dismissal, prolonged work stoppage, divorce, death of the person with whom you live as a couple...).)

Unpaid monthly payments due to the suspension will not be claimed from you in 1 single installment at the end of the grace period. They can be paid over the remaining term of your credit or be deferred until your credit is repaid.

If you are unable to meet your debts, or if you know that you will not be able to meet them, you can file an overindebtedness file.

This is the case, for example, when the court has granted you the suspension of your monthly mortgage payments, but this solution has not resolved your difficulties.
