Help related to the recognition of the burden of disability (RLH): what are the rules?

The aid linked to the recognition of the burden of disability (RLH) makes it possible to compensate financially for the consequences of your disability on your professional activity. You are affected by this assistance if you exercise a self-employed professional activity. This assistance is granted if you have adapted your position or work environment and costs persist after these adjustments. We're taking stock of the regulations.
Please note
If you are an employee, assistance related to the recognition of the severity of the disability shall be allocated to your employer.
To obtain LHR assistance, you must comply with the 3 following conditions :
- Exercising a self-employed professional activity (craftsman, liberal profession...)
- Set up your workstation or work environment and bear the resulting costs
- Be among the beneficiaries of the employment obligation of disabled workers (OETH).
The persons concerned by the OETH are those who are in one of the following situations :
- To be recognized disabled worker (RQTH) by the Commission on the Rights for the Autonomy of Persons with Disabilities (CDAPH)
- Be a beneficiary of the mobility inclusion card (CMI) disability mention
- Be a beneficiary of the Disabled Adult Allowance (DAA)
- Have been the victim of an occupational disease or illness that has resulted in a permanent disability of at least 10% and receive an annuity
- Be a beneficiary of a invalidity pension provided that the invalidity reduces his working or earning capacity by at least 2/3
- Have occupied a reserved employment (military, ...) and receive an invalidity pension
- Have been volunteer firefighter and receive an invalidity allowance or annuity awarded because of an accident or illness that occurred in service.
FYI
Such persons shall receive a certificate issued to them at the same time as the notification the decision placing them in one of those situations. This attestation clearly states that the person is a beneficiary of the OETH which allows you to assert your rights.
In order to qualify for RLH assistance, you must first apply for recognition of the burden of disability (RLH) with the Association for the Management of the Fund for the Professional Integration of Persons with Disabilities (Agefiph).
This request must be made online through an online service:

Your LHR application must be accompanied by the following documents:
- Proof of eligibility for OETH (e.g. recognition of disabled worker status, invalidity card) valid for at least 6 months from the application for RLH
- Proof of registration or registration attesting to your activity as a self-employed person
- Proof of the professional income declared for the previous year (e.g. declaration of professional income)
- Proof of costs incurred in connection with the fitting out of your workstation or work environment (invoices)
- Proof of expenses incurred for expenses incurred by your disability (for example, proof of professional income from the activity of your guardian or third-party caregiver)
- Bank Identity Statement (Rib) of the company.
These documents must be scanned.
The Agency shall issue its decision by letter. This letter states the following:
- Favorable or unfavorable opinion
- Heaviness rate of your disability (normal or increased)
- Remedies available to challenge the decision, in case of refusal.
It is only once the Agency has granted you the RLH that the financial assistance related to the RLH is granted.
The amount of aid linked to the RLH depends on the rate of the severity of the disability set by the Agefiph: normal rate or increased.
This rate is determined according to the annual amount of your permanent professional expenses related to your disability (particular organization of work, social or professional support, loss of income due to lower productivity...).

Normal rate
The amount of aid linked to the RLH is €6,611.00 per year for a full-time activity.
The amount of the aid shall be paid to the pro rata actual working time completed each month.
Increased rate
The amount of aid linked to the RLH is €13,161.90 per year for a full-time activity.
The amount of the aid shall be paid to the pro rata actual working time completed each month
The aid linked to the RLH is paid every 3 months on declaration of hours worked.
It all depends on your age at the time you apply for LHR:
- Either you're 50 gone or more on the day you file your application
- Or you are under 50 years of age at the date of filing your application.

50 years or older
The RLH is awarded until the end of your professional activity.
Under 50
The RLH is allocated for 3 years maximum.
However, if your position or work environment changes, you must file a new request for review with the Agency.
