Physical incapacity of the probationary official: what consequences?

If you are a probationary civil servant and unfit to perform your duties at the end of your sick leave entitlements, you can be placed in unpaid leave in the event oftemporary incapacity or licensed in the event ofpermanent incapacity. We present these provisions according to your public service (State - FPE, territorial - FPT, hospital - FPH).
EPF
When you are unable to return to your duties at the end of your sick leave entitlement, you may be placed on unpaid leave for a maximum period of one year renewable twice.
Placement on unpaid leave may occur when you have exhausted your entitlement to the following leave:
- Sick leave of one year
- Long-term Sick Leave (LSL) of 3 years
- Long-term leave of 5 years
- Temporary Service Disability Leave (Citis) 5 years if you are not a permanent civil servant in another body or employment.
Your unpaid leave and its renewal are pronounced after notice of the medical advice.
At the end of your unpaid leave for health reasons, you are reinstated to your workstation.
You can benefit from a part-time for therapeutic reasons, unless your internship involves vocational education or is to be completed in a training institution.
When you are absolutely and definitively unable to resume your duties at the end of your sick leave entitlements, you are licensed.
Dismissal may thus occur when you have exhausted your rights to the following leave:
- Sick leave of one year
- Long-term Sick Leave (LSL) of 3 years
- Long-term leave of 5 years
- Temporary Service Disability Leave (Citis) 5 years if you are not a permanent civil servant in another body or employment
- Unpaid sick leave of 3 years.
Your definitive incapacity is pronounced after notice of medical advice.
If you are a registrant in another body or framework of jobs, your secondment for traineeship is terminated and you are made available to your home administration.
Your home administration is looking into the possibilities of assigning you to a position adapted to your physical capabilities or place you in disability pension.
If your physical incapacity is due to an accident at work or an occupational disease, you are entitled to a annuity of invalidity.
Its amount is set in the same conditions only to the general regime of Social Security.
The rate of disability taken into account for the calculation of the pension is determined by the medical board.
The pension is paid to you by the administration that employed you as a probationary civil servant.
FPT
