A student may be forced to change schools because of the behavior of one of his parents

A new procedure is being introduced in schools to respond to acts that pose a risk to the safety or health of teachers and other members of the educational community. In particular, it is envisaged that a pupil may be required to change schools because of the behavior of a member of his family. Public Service introduces you to this new procedure.

The decree published in the Official journal of the French Republic of 29 july 2026 aims to strengthen the protection of the educational community (teachers, education assistants, educators' assistants, etc.). To this end, it introduces a new procedure applicable in nursery schools, elementary schools, colleges and high schools. This procedure may be activated by school principals and school leaders when the behavior of a family member of a pupil, related to the latter's schooling:

  • weighs a significant risk to the safety or health of a member of the educational community ;
  • seriously jeopardizes the conduct of teaching activities, or the normal functioning of the school or establishment.

The new procedure provides that when faced with such situations, school principals, middle school principals and high school principals may refer the matter to the academic director of the national education services (in each department, an academic director of the national education services is responsible in particular for directing the departmental services of national education of the territory in which he is appointed).

The Academic Director of the National Education Services must then meet with the child's parents.

Second, the process differs somewhat depending on the degree of the school: on the one hand, nursery and elementary schools; and on the other hand, colleges and high schools.

  • Where the proceedings relate to events taking place in a nursery or elementary school
    After his meeting with the parents of the child, the academic director of the national education services may ask the mayor of the commune to send the pupil back from the school and enroll him in another establishment of the city (or another establishment present in the intercommunality, if the management of the operation of the public schools has been transferred to a public inter-municipal cooperation institution).
    If there is only one public school in the municipality, the pupil may be expelled only if the mayor of another city agrees to enroll him in an establishment in his municipality.
  • Where the proceedings concern events taking place in a secondary school or high school
    The academic director of the national education services may, following his or her interview with the child's parents, assign the child to another school.

Please note

Pending the decision of the Academic Director of the National Education Services, school principals, principals and principals of high schools have the possibility of prohibiting the pupil and/or the member of his/her family concerned from entering the school during the period of the procedure (this suspension of access to the school may not, in any event, exceed 5 days).

In the new school (whether it is a nursery school, an elementary school, a college or a high school), the pupil receives enhanced pedagogical, educational and social follow-up, until the end of the current school year. This follow-up must enable him to be taken care of, within the institution, in an individualized manner and adapted to his personal situation.

This guide is available in 2 versions: one is for first degree personnel (nursery and elementary schools); and another to the second degree (middle and high schools).
