New pricing rules introduced for some Ehpads in 2025

A decree issued in Official Journal of 1er January 2025 changes the conditions under which some Ehpads may charge different accommodation rates depending on whether their residents are receiving social assistance for accommodation. It is established that the tariff increase for persons who do not receive this aid must be a maximum of 35 %.

Not all Ehpads can accommodate social assistance for housing (ASH). The social assistance eligible Éhpad (all public Éhpad and most community-based Éhpad), for their part, welcome not only beneficiaries of ASH but also people who are not eligible for it.

Since 2005, these establishments have been free to set an accommodation rate for residents who are not beneficiaries of ASH. In order to regulate this rate, Éhpad had to conclude a social assistance agreement with the departmental council of its location. The accommodation rate applied to residents who benefited from the ASH was, for its part, directly defined by the departmental councils.

An order issued in Official Journal of 1er January 2025 amended the pricing arrangements for these PFAs. The rate applied to residents receiving ASH remains defined by the departmental councils; and the decree sets at 35% the maximum difference, for identical services, between the accommodation rate applied for ASH beneficiaries and that applied for non-beneficiaries of this aid. When differentiated pricing is introduced, an Éhpad must inform the departmental council of its location. The county council has the possibility to reduce the price gap established by Éhpad, in order to preserve an affordable accommodation offer within its territory.

The PTAs can use these new pricing arrangements for persons arriving at their establishment from 1er January 2025.

The price of accommodation at Les Éhpad includes:

  • the provision of a room;
  • maintenance of private and common areas;
  • the catering services (access to a catering service, as well as 3 meals, a snack and the provision of a night snack);
  • social activities (access to group activities and activities organized on the premises...).
