Can an employee receive unemployment benefit in case of resignation?

Your resignation may be legitimate if it is justified by the conclusion of one of the following contracts:

• Civic service contract
• Contracts of international solidarity volunteering or voluntary association, of a minimum continuous duration of one year.

You are entitled to the ARE even if the mission is interrupted before the end of the minimum period of engagement provided for in the contract.

Before you resign, check that you meet all of these conditions.

If you meet this condition, you can collect the RCA.

If your resignation is not considered legitimate, However, there are 2 options to be compensated under the ERA:

• You work at least 3 months (65 working days or 455 hours) after you resign
• After 121 days of unemployment (about 4 months), you can ask France Travail the review of your situation to get the ARE.

A regional joint authority (RPI) of France Travail is responsible for verifying that the following 2 conditions are met:

• Complete the conditions of award of the ARE (other than the condition of involuntary deprivation of employment)
• Provide evidence of your active job search, possible short-term job openings and your steps to undertake training.

If your request is accepted, the starting point for the payment of the AER shall be as soon as possible 122^e day of unemployment.
