Visale guarantee: deposit for the tenant (unpaid and damaged)

What is the Visale Warranty? It's a rental deposit free, thatHousing Action granted for certain housing units rented in metropolitan France, in the Drom or in Saint Martin (Com). For this, the tenant must obtain the Housing Action visa and the landlord must accept the act of surety. In the event of rental damage or unpaid rent, Action logement first pays the landlord the amount due, and is then reimbursed by the tenant. We explain.
The rules are different depending on the location of the rental accommodation:
Île-de-France
The tenant and the landlord must not be members of the same family (grandparent, parent, or child).

Intergenerational cohabitation between a landlord over 60 years old and an alternate or a young person under 30 years old is eligible for the Visale guarantee, when it is a solidarity intergenerational cohabitation set up as part of the Cohabilis network.

Action Logement verifies whether the tenant complies with the conditions to obtain the Visale guarantee.

3. The tenant shall give the landlord the visa
The tenant can download and print the visa from sound personal online account.
The tenant must give it to his future landlord.
4. The lessor shall request the act of surety
The landlord must first create his personal space on the site Visale.fr :
Landlord: access to his personal space on Visale.fr
It then indicates the number of the visa, the name of the tenant and the characteristics of the accommodation.
A proposed act of surety is automatically created. The owner must validate it.
5. Signature of the lease
Once this process has been completed, the tenant and the landlord can sign the lease, benefiting from Action Logement's guarantee.

The lessor must comply with the following steps:
1. From the first unpaid payment
Within 15 days of unpaid payment, the landlord must claim payment of the rent from the tenant, by means of a formal notice to pay sent by registered letter with acknowledgement of receipt.
As soon as the unpaid amount exceeds the total of one month's rent and charges (net of housing assistance), the lessor can report the unpaid amount to Action Logement from its personal space online.
Example :
For €450 monthly rent and €50 monthly charges,
- When the tenant does not receive housing assistance, it is possible to declare the unpaid amount as soon as its amount exceeds €450 + €50 = €500
- When the tenant receives housing assistance from €120, it is possible to declare the unpaid amount as soon as the amount exceeds €450 + €50 - €120 = €380.
After declaration of unpaid by the lessorand in support of supporting documents, Action Housing issues a subrogative release, which the lessor must validate online.
As soon as it is validated, release subrogative allows Action Housing to:
- To pay to the lessor, within 5 working days, the amount of that receipt
- To recover from the tenant the amount of this receipt.
As long as the tenant has not repaid all of his debt Action à Logement, the lessor must, from his personal space online, update monthly on tenant account, including where the tenant has resumed payment of the rent.

2. Where the tenant does not resume payment of the rent
Every month, the lessor must update, since its personal space online, on tenant account and declare the new unpaid amount, as well as any sums paid by the tenant.
This allows Action Logement to implement the recovery procedure and to cover the costs of this procedure. The recovery procedure can go as far as the termination of the lease and the eviction of the tenant, if necessary.

After recovering the accommodation, the lessor must:
- Notify Action Logement of tenant's departure
- And provide Action Housing within 60 days, the balance of any account it has given to the tenant.

Action Logement, after having paid the amounts due to the lessor within the limit of the amount taken care of, recovers these sums from the tenant.
The tenant reimbursed Action Housing according to a timeline, which may be adjusted to take account of its financial situation. The tenant can make the request within 2 months of the request for reimbursement, from his personal space online.
The tenant must pay his refunds from his personal space online.
Warning
When the tenant is not on schedule of its refunds, Action Logement may ask the judge to termination of the lease (i.e. the end of the lease).
After recovering the dwelling, the landlord 60 days to ask Action Logement to take charge of the rental damage.
For this, from its personal space online, he must provide all the documents justifying the deterioration (inventory) and repair (invoice).
Action Housing issues a release subrogative, which the lessor must validate online.
As soon as it is validated, subrogative release allows Action Housing to:
- To pay to the lessor, within 5 working days, the amount of that receipt
- To recover from the tenant the amount of this receipt.
Other region
The tenant and the landlord must not be members of the same family (grandparent, parent, or child).

The lessor must comply with the following steps:
1. From the first unpaid payment
Within 15 days of unpaid payment, the landlord must claim payment of the rent from the tenant, by means of a formal notice to pay sent by registered letter with acknowledgement of receipt.
As soon as the unpaid amount exceeds the total of one month's rent and charges (net of housing assistance), the lessor can report the unpaid amount to Action Logement from its personal space online.
Example :
For €450 monthly rent and €50 monthly charges,
- When the tenant does not receive housing assistance, it is possible to declare the unpaid amount as soon as its amount exceeds €450 + €50 = €500
- When the tenant receives housing assistance from €120, it is possible to declare the unpaid amount as soon as the amount exceeds €450 + €50 - €120 = €380.
After declaration of unpaid by the lessorand in support of supporting documents, Action Housing issues a subrogative release, which the lessor must validate online.
As soon as it is validated, release subrogative allows Action Housing to:
- To pay to the lessor, within 5 working days, the amount of that receipt
- To recover from the tenant the amount of this receipt.
As long as the tenant has not repaid all of his debt Action à Logement, the lessor must, from his personal space online, update monthly on tenant account, including where the tenant has resumed payment of the rent.

2. Where the tenant does not resume payment of the rent
Every month, the lessor must update, since its personal space online, on tenant account and declare the new unpaid amount, as well as any sums paid by the tenant.
This allows Action Logement to implement the recovery procedure and to cover the costs of this procedure. The recovery procedure can go as far as the termination of the lease and the eviction of the tenant, if necessary.

Action Logement, after having paid the amounts due to the lessor within the limit of the amount taken care of, recovers these sums from the tenant.
The tenant reimbursed Action Housing according to a timeline, which may be adjusted to take account of its financial situation. The tenant can make the request within 2 months of the request for reimbursement, from his personal space online.
The tenant must pay his refunds from his personal space online.
Warning
When the tenant is not on schedule of its refunds, Action Logement may ask the judge to termination of the lease (i.e. the end of the lease).
