Can the insurer refuse compensation in the absence of a smoke detector?

Verified 05 December 2025 - Public Service / Directorate of Legal and Administrative Information (Prime Minister)

Each dwelling must be equipped with at least 1 autonomous smoke alarm (DAAF).

It's at owner to settle it, but the tenant must ensure regular maintenance.

Once the smoke detector is settled in your home, you must declare to your insurer, whether you are a tenant or owner.

It is enough to give him a certificate of installation (model available online) accompanied by a proof of purchase or installation (invoice, photo, certificate of conformity,...).

This declaration can be made by mail or by email.

You can use a template:

Provided you have subscribed one fire warrantyHowever, your insurer cannot refuse to compensate you, nor reduce the amount of the compensation on the sole ground that you have not settled a smoke detector.

However, if it proves that this absence aggravated the consequences of the loss, a reduction in compensation may be considered.
