Can you keep your social housing in case of an increase in income?

Verified 01 January 2026 - Public Service / Directorate of Legal and Administrative Information (Prime Minister)

When your income increases, you may be forced to pay overrent (or solidarity rent supplement, says SLS). But if your income increases very strongly, you may be forced to leave your home. Depending on where your home is located or your personal situation, this rule may not apply:

You must leave your home within 18 months, starting on 1er January of the year following these two consecutive years.

Six months before the end of these 18 months, the lessor must indicate you, by registered letter with acknowledgement of receipt or by act of bailiff (now called commissioner of justice), the date on which you must have left the accommodation.

The landlord does not have to make you a proposal for rehousing.

Example :

For an overrun in 2026 and 2027 (2 consecutive years):

  • The deadline to leave your accommodation starts from 1er January 2028. You must leave the accommodation no later than 1er July 2029.
  • No later than 1er january 2029, the lessor informs you, by registered letter with acknowledgement of receipt or by act of bailiff, that you must have left the accommodation no later than 1er July 2029.
