Social housing: solidarity rent supplement (overrent)

A solidarity rent supplement (SLS) called overrent can be claimed from the tenant when the total income of the persons living in the dwelling exceeds by at least 20% a specific amount. This specific amount varies depending on whether the accommodation is located in Île-de-France, in the provinces or overseas. We explain.

Île-de-France

You are forced to pay an overrent if the total annual income of the people living in your home exceeds of at least 20% a specific amount.

This specific amount depends on the type of your social housing (PLAI, PLUS, PLS).

  • For a housing type PLAI or PLUS, this is the maximum amount of income for the allocation of a social housing type PLUS.
  • For a PLS-type dwelling, this is the maximum amount of income for the allocation of this type of social housing.

But you don't have to pay overrent if your home meets at least 1 of the following conditions:

Paris or neighboring municipality

The communes bordering Paris are Aubervilliers, Bagnolet, Boulogne-Billancourt, Charenton-le-Pont, Clichy, Fontenay-Sous-Bois, Gentilly, Issy-les-Moulineaux, Ivry-sur-Seine, Joinville-le-Pont, Le Kremlin-Bicêtre, Les Lilas, Le Pré-Saint-Gervais, Levallois-Perret, Malakoff, Montreuil, Montrouge, Neuilly-sur-Seine, Nogent-sur-Marne, Pantin, Puteaux, Saint-Cloud, Saint-Denis, Saint-Mandé, Saint-Maurice, Saint-Ouen, Suresnes, Vanves, Vincennes.

The annual amount of your rent (excluding charges) increased by the annual amount of the overrent cannot exceed 30% of the total annual income of the persons housed.

Annual survey of the lessor

Overrent (SLS) due from 1er January (of year N+1) is calculated by the lessor in the previous year (or year N).

The landlord first conducts a resources survey to find out if you are liable for the overrent. The questionnaire is distributed to you during the 2e semester of year N.

Within one month, you must complete the questionnaire and provide the following documents:

  • Last tax notice of each person living in the dwelling
  • If necessary, mobility card included with the mention invalidity.

For example, for overrent due from 1er January 2026, the survey is conducted in 2025 and tenants must provide the 2025 tax notice (covering their income received in 2024).

Based on this information, the landlord calculates the amount of overrent due. It provides you with information to verify the amount of overrent required.

Please note

The landlord is not obliged to send you the survey resources if you receive housing assistance (APL: titleContent, ALF: titleContent or ALS: titleContent).

No response to the annual survey

You have an obligation to respond in a period of one month.

If you don't, the landlord will send you a formal notice. No response within 15 daysHowever, you must pay a higher amount of overrent and pay an indemnity for €25.

Upon receipt of the information by the social landlord, the latter regularizes your situation regarding overrent. The overpayment will be returned to you within 2 months.

If you don't answer the resources survey for 2 consecutive years, you must leave your home (except for exceptions).

In the event of a drop in income

Reminder

The overrent due to 1er January of year N is calculated as year N-1 on the basis of the resources received in year N-1.

If your income drops, you can tell your landlord so he can recalculate the amount of your overrent.

Your landlord will apply a new amount of overrent if you meet the 2 following conditions :

  • Your resources for year N or your resources over the past 12 months are at least one less 10% to those of year N-1
  • You ask for it in support of supporting documents.

The new amount applies from the month following the month in which your income fell, provided that you have submitted the supporting documents within 3 months after this event.

If you submit the documents after this 3-month period, the new amount applies from the month following your submission.

When the people housed change

If the composition of your family changes (for example, the birth of a child), you can tell your landlord so that he can recalculate the amount of your overrent. To do this, you must provide at least one supporting document.

The new amount of overrent will be applicable from the month following the month in which the change occurred, provided that you submit the supporting documents within 3 months after this event.

If you submit these documents after this period, the new amount applies from the month following the transmission.

Calculation Rule

The overrent is calculated with the following figures:

  • Living area of the dwelling (HS) in m2
  • Resource Cap Overrun Coefficient (CDPR) the allocation of social rental housing (CDPR).
  • Reference rent supplement (RLS), i.e. the amount in euro per m² of living space. This amount is fixed according to the location of the housing.

The monthly amount of the overrent is calculated according to the following rule: Overrent = HS x CDPR x SLR.

In Guadeloupe, French Guiana, Martinique, Reunion and Mayotte, the monthly reference rent supplement is €0.31, by m2 habitable.
