You have been the victim of a traffic accident and your vehicle is seriously damaged? In this case, a specific procedure may be initiated to check whether the vehicle can continue to circulate safely. The procedure takes place in several stages, from the identification of the hazard to the decisions on the repair or destruction of the vehicle.

Step-by-step approach

Procedure

When the vehicle presents an immediate danger, law enforcement may decide to stop it. They may also withdraw the registration certificate or report the situation to the Ministry of the Interior for an objection to be registered. In any case, a notice of withdrawal is given to you to inform you of the decision.

A vehicle whose structure is strongly deformed after an impact may be immediately banned from circulation.

Consequences

You can no longer use your vehicle on public roads. Furthermore, you cannot sell or give it away until the situation is regularized.

Procedure

Following the expert report, two situations may arise:

  • If the vehicle is irreparable or if the cost repairs exceeds its value, the insurer implements the “economically irreparable vehicle” procedure and may offer to buy the vehicle back.

Once the repairs have been validated, you can request that the vehicle be put back into circulation.

However, if you accept the insurer's offer, the insurer will take care of the destruction of the vehicle. If you refuse this offer, you keep the vehicle, but you can only give it to one licensed professional for destruction.

The Ministry of the Interior intervenes to update the administrative situation of the vehicle.

Depending on the conclusions of the expert opinion and the decisions taken, the administration may lift the objection entered on the registration certificate. It may also return or reissue this certificate if the vehicle is again authorized to circulate.

You can then use your vehicle legally again. You also find the possibility to sell or give it away, in compliance with the applicable rules.

Thus, after validation of the repairs by the expert, you can recover your {circumflex over (D)} and resume the use of the vehicle.
