Maintenance book of the condominium

In a condominium, the trustee has a legal obligation to establish and maintain a maintenance book for the building. This is a mandatory document that is intended to list the technical and administrative information of the building. We present you the information to know.

The maintenance book of a condominium concerns the common areas from a building. It should therefore not be confused with the housing information booklet.

The maintenance book is a information tool for co-owners and purchasers. Indeed, it makes it possible to know the technical condition of the building, through the works carried out, the maintenance contracts and the programmed works.

The maintenance book is also a condominium management toolsince it traces the history of major works and maintenance contracts. This facilitates the programming and tracking of routine maintenance and large works.

The maintenance book is established, maintained and updated by the syndic of co-ownership. It does not have to obtain the prior consent of the syndicate of co-owners to draw up the maintenance log.

When the condominium comprises several buildings:

  • The trustee must open one chapter per building in the maintenance book
  • In the presence of one or more secondary trade unions, the trustee must keep an up-to-date maintenance book for each of them. In this case, the trustee opens a chapter in the main union's notebook for the parts common to all the unions.

These services are included in the liquidator's lump sum remuneration and cannot not give rise to additional remuneration.

Mandatory information

The maintenance log must mention at least the following:

Other information is also required if cases arise:

  • Year of completion of major works (e.g. facade refurbishment, roof repairs, elevator, boiler or pipe replacements) and identity of companies who completed these works
  • References of non-life insurance contracts subscribed on behalf of the syndicate of co-owners whose guarantee is in progress
  • References to and expiry date of maintenance and maintenance contracts for common equipment
  • Works prescribed in multi-year works plan (MPP) and timeline.

Additional information

The maintenance log may include any additional information that the co-owners decide to include in it. The decision to add this additional information is voted in the general meeting of co-owners at the simple majority.

This may include information on the construction of the building or on the technical studies carried out (for example, the global technical diagnosis (GTD) or the collective energy performance diagnosis).

The condominium trustee must offer online access to allow all co-owners to consult the maintenance book. This document must be downloadable and printable.

Co-owners can also obtain a copy of the maintenance book from the trustee. This request is subject to payment. The price is freely fixed by the trustee in his contract.

FYI  

A copy of the maintenance log must also be attached to the promise to sell from the batch.

The maintenance log must necessarily be part of the archives that are delivered by the trustee to his successor in case of change of trustee.

Failure to establish a maintenance log or update the log may:

  • Incur the liability of the trustee if the syndicate of co-owners suffers damage as a result of this failure
  • Justify the early termination (revocation) of the trustee's mandate.
