How can I change my condominium trustee at the end of my term?

The duration of the trustee contract is, in principle, 3 years. The contract ends at its end, except in the case ofearly termination of the mandate.

On that date, the syndicate of co-owners may:

  • Designate the same trustee (renewal of his mandate) and a new contract is approved by the general meeting of co-owners
  • Or appoint a new trustee. In this case, there is no particular reason to declare.

For changing trustee at the end of his term, it is necessary to follow several steps to avoid any interruption in the management of the condominium.

Step-by-step approach

First, the union council must perform a competitive tendering several draft trustee contracts. In practice, this involves interviewing several trustees in order to obtain:

  • A draft contract, which must comply with the standard contract of which the content is regulated,
  • A factsheet on the price and the services offered.

These elements allow co-owners to compare the different proposals.

Where it is the syndicate of co-owners that does not wish to renew the mandate of the existing trustee, the question of the appointment of a new trustee must be registered in theagenda of the general assembly.

For this, a request for inclusion on the agenda must be sent to the trustee accompanied by:

  • A draft resolution (one resolution per applicant trustee)
  • The draft contract(s) of the applicant trustees.

This letter must be sent by registered letter with acknowledgement of receipt.

The trustee may not refuse to include this matter on the agenda, nor to assess its appropriateness.

A general meeting must then be convened before the expiry date of the current mandate. This meeting is to take place in the 3 months before the end of the contract.

Please note

It is important that the General Assembly be summoned and held as long as the trustee still performs his duties to avoid any challenge and invalidity risks. Indeed, if the trustee convenes the general meeting when his term of office has expired, the convening is irregular and the general meeting risks cancelation.

THEagenda of the general meeting must include the questions of the appointment of a new trustee and the fixing of the dates of termination of the current contract and the entry into force of the new contract.

Draft trustee contracts are sent to co-owners at same time that the agenda of the general assembly. They are annexed to the summons at the general meeting.

FYI  

If the current trustee does not respect his obligation to convene a general meeting, any co-owner may ask the president of the judicial court of the place of situation of the immovable to appoint a provisional administrator to convene the general meeting. This request is made in the form of query. It is mandatory to be accompanied by a lawyer.

Who shall I contact

The general meeting of co-owners must vote successively for each trustee's candidacy to the absolute majority Article 25.

FYI  

If no candidate obtains the absolute majority of article 25 but one of them obtains at least ⅓ of the votes of all the co-owners, the latter can make a 2nd vote at the same meeting at the simple majority Article 24.

At the general meeting, the co-owners set the dates for the end of the current contract of the former trustee and for the new contract of the new trustee to take effect. The new contract shall take place as soon as possible 1 free day after that meeting.

Warning  

In the event of non-renewal of the contract, the outgoing trustee is not entitled to any compensation.

The contract of the new trustee shall take effect on the date decided by the syndicate of co-owners, at the earliest 1 free day after the general meeting.

This rule ensures continuity in the management of the condominium. It also ensures the transition without overlapping mandates between the outgoing trustee and the newly appointed trustee.

FYI  

The former trustee must transmit documents to the new trustee under certain deadlines.
