Is a temporary worker monitored by occupational medicine?

An employee of a temporary work company benefits from same medical follow-up as other employees, but this follow-up is carried out under suitable conditions to its status. These conditions concern in particular the information and prevention visit (Vip) and enhanced individual monitoring. We're taking a look at the regulations.

Yes, the temporary employee shall be entitled to Vip.

It is carried out by the Occupational Health and Prevention Service (OHPS) the temporary company of work that employs the employee.

The temporary company of work may, subject to their agreement, arrange for such a visit to be carried out by:

  • Intercompany prevention and occupational health service close to the employee's workplace
  • Self-employment prevention and health service of the user company under the conditions established by agreement with the temporary work company.

The visit can be made for 3 jobs maximum.

Yes, the temporary employee benefits from a enhanced individual monitoring if exposed to a special risk (asbestos, ionizing radiation, etc.).

The medical examination of aptitude is in this case carried out by the occupational doctor of the user company. It can be performed for 3 jobs maximum.

If the temporary employee is affected during the mission to a post with a special risk, the user company shall organize a medical examination of suitability. This medical examination is not carried out if the employee has received enhanced individual follow-up.

  • Worker called to occupy a identical use with equivalent exposure risks
  • During the Last 2 years, the occupational physician did not issue of unfit opinion or individual measures for the accommodation, adaptation, transformation of the position or working time.

Enhanced Individual Monitoring (IRS)

He is not not achieved of a new medical examination of competence before a new mission if the following conditions are met:

  • Knowledge by the occupational physician of an aptitude notice for the same job issued in the 2 years preceding the hiring
  • Worker called to occupy a identical use with equivalent exposure risks
  • During the Last 2 years, the occupational physician did not issue of unfit opinion or individual measures for the accommodation, adaptation, transformation of the position or working time.

Yes, the temporary employee can benefit from the following medical visits:

Pre-trade visit

Temporary employee on sick leave more than 30 days may benefit, at his request, a visit by pre-trade.

Resumption visit

The temporary employee is granted a return visit in the following cases:

  • After maternity leave
  • After an absence due to occupational disease
  • After an absence of at least 30 days for accident at work
  • After an absence of at least 60 days due to illness or non-occupational accident.

The employer shall arrange this visit at the latest within 8 days following the recovery.

The organization of the return visit is not required when all of the following conditions the following shall be met:

  • Benefit of a visit of pre-trade by the temporary employee in 30 days before the actual resumption of work
  • And the occupational physician concluded that was not necessary with a view to recovery:
    • D'develop,adapt or transform the position of the employee
    • Ordevelop the working time of the employee.

Despite this exemption, the occupational physician, the employer or the employee may request the organization of a return visit.

Mid-career medical visit

One mid-career medical examination is organized the calendar year of the worker's 45th birthday.

One branch agreement may provide for another deadline.

The time spent on medical visits and examinations, including further examinations, is:

  • Taken from working hours (in this case, the employee is paid as if he had worked)
  • Or paid as actual working time when such examinations cannot take place during working hours.

The transport time and the costs made necessary for these visits and examinations are covered by the employer.
