Victim of crime: compensation from the Guarantee Fund for Victims of Terrorism and Other Offenses (FGTI)

Warning
The ITGF does not intervene not if you are a victim of a traffic accident, of a hunting accident or a asbestos-related disease.
Can compensation be provided by the ITGF regardless of where the offense was committed?
The conditions for receiving compensation from the ITGF differ depending on where the offense was committed:
Infringement in France
You can be compensated by the guarantee fund if you are a victim of a offense.
You can also benefit from compensation if you are the person entitled of a deceased victim and that you suffer personal injury as a result of this offense.
For example, this is the case if your spouse has died, which results in a loss of income within the household.
Offense abroad
You can be compensated by the Victims Guarantee Fund under 2 conditions:
- You regularly reside on French territory or you are a citizen of l'
- The offense was committed in France.
If you are a relative of the deceased victim and you meet these 2 conditions, you can also claim compensation to repair the injury personnel you are undergoing. For example, this is the case if your spouse has died, which results in a loss of income within the household.
What offenses may result in compensation to the victim by the ITGF?
The Victims Guarantee Fund can compensate you for offenses that have caused you a bodily harm (personal injury) or material damage (damage to property).

Attack on the person
The conditions for compensation and the amount of compensation depend on the seriousness of the damage suffered:
Severe impairment
Your harm may be totally compensated by the Civi: titleContent if you were a victim direct or indirect :
- Of an offense resulting in death, permanent incapacity or total incapacity for work of at least 1 month
- A sexual offense (rape, sexual assault, etc.)
- From pimping or slavery.

For all these cases, compensation can be requested without any special conditions and regardless of the amount of your financial resources.
Minor bodily harm
In the event of minor bodily harm, the conditions of compensation depend on the offense suffered and your personal situation:
General scenario
In the case of minor bodily injury, all of the following conditions must be met:
- You are a victim direct or indirect personal injury resulting in total incapacity for work less than 1 month
- Your resources are below the partial legal aid, or €19,433 (for a single person)
- The offense has resulted in serious disturbances in your life (for example, inability to lead a normal family life)
- You cannot obtain compensation for your damage from other organizations.

The maximum amount of money you can get paid varies depending on the number of dependants you have.
The amount of compensation is capped at €4,857.

Violence against minors, spouses, partners of Civil partnerships or cohabiting partners
Your damage can be compensated if you meet the following conditions:
- You are a victim of violence resulting in total incapacity for work 8 to 29 days
- This offense was committed while you are a minor or by the person with whom you are or were married, entered into a civil partnership or cohabiting
- You cannot be compensated by another organization.
If you are in this situation, the amount of compensation you can get is capped at €5,000.
Infringement of property
The conditions for compensation and the amount of compensation depend on the offense committed:
General scenario
You can receive compensation when you are a victim direct or indirect of any of the following offenses:
- Theft, scamextortion, breach of trust, deterioration, destruction or degradation (excluding arson)
- Or blackmail, abuse of weakness or breach of automated data processing systems (if this breach was committed from November 22, 2023).
In addition, you must meet all of the following conditions to be compensated:
- You are in a serious material or psychological situation (lack of money, moral distress, etc.)
- You cannot obtain compensation for your damage from other organizations
- Your resources are below the partial legal aid, or €19,433 (for a single person).

Voluntary vehicle fire
To qualify for compensation, you must meet all of the following conditions:
- The fire volunteer from land motor vehicle took place on French territory
- You have not been compensated by another organization
- At the time of the occurrence, the roadworthiness test and insurance of the vehicle were valid
- Your resources do not exceed €29,149.50 (for a single person).

Squat of a dwelling
If your home is the subject of a squat, you can claim compensation under 2 conditions:
- You are in a serious material situation because of the offense (for example, you can no longer access your accommodation)
- You cannot obtain compensation for your damage from other organizations.
In this case, you have the possibility to make a claim for compensation regardless of your financial resources.
You will be compensated up to €3,000 maximum.
To obtain compensation, you must make a claim within the following deadlines:
- 3 years from the date of the offense, if there has not yet been a trial
- 1 year from final decision rendered by a criminal jurisdiction, if there has already been a trial.
Exceptionally, the Civi: titleContent may accept an application submitted out of time for a legitimate reason.
This is the case if you have not been able to assert your rights in time or if you have suffered a worsening of your injury.
To be compensated by the FGTI: titleContent, you (one legal representative or your lawyer) must apply to the Crime Victims Compensation Board (Civi).
To do this, you must fill out the following form:
Claim for compensation from the Crime victims' compensation board (Civi)
Then you must send your file (form + supporting documents required) to the Civi: titleContent on which you depend.

The delivery can be done by hand or by registered letter with acknowledgement of receipt.
In principle, the competent Civi is the one of your domicile or the place of criminal jurisdiction in charge of your case.
If you live abroad and the events took place abroad, the competent Civi is that of the Paris court.

When you fill out the claim form, you can also request a provision if the amount of your damage has not yet been assessed. If the file is complete and your right to compensation is not disputed, the FGTI will pay you this provision within one month of the transmission of the file by the Civi: titleContent.
The request is processed by the FGTI: titleContent, after the submission of the complete dossier by the Civi: titleContent. The FGTI has 2 months from the receipt of your complete file to formulate an offer of compensation.
During these 2 months, the FGTI analyzes your file, conducts an investigation and can conduct hearings (example: hearing your doctor).
If your application is admissible, he makes you an offer that indicates the amount of compensation proposed.

The compensation paid by the ITGF may be the same, less than or greater than the damages and interest that the author of the offense was ordered to pay you.
You have 2 months to respond to the compensation offer. You can accept it or reject it.
Warning
Your silence for 2 months is a refusal.
You accept the offer
If you accept the offer, it becomes a statement of agreement.
The statement of agreement shall be forwarded for approval to the President of the Civi: titleContent.
If the President of Civi carries out the approval, the statement of agreement acquires the enforceability.
The registration decision is yours notified at the same time FGTI: titleContent.
The FGTI must then pay compensation in a delay of 1 month after notification of the approval decision.
You refuse the offer
If you refuse the offer, you can make a new claim for compensation by submitting a query to the Civi: titleContent. The application must be accompanied by all the information necessary to determine the amount of compensation.
Thus, a procedure is initiated before the Civi and gives rise to a hearing.
Following the hearing (to which you are summoned), the Civi makes a decision that enforceability. This decision of the Civi (compensation or rejection of your claim) is notified to you at the same time as to the FGTI.
If your application is accepted, the FGTI must pay compensation in a delay of 1 month following the notification the new Civi decision.
If the decision of the Civi does not suit you (e.g. in case of rejection or if the offer of compensation is insufficient), you can challenge it. This remedy must obligatory be carried out by a lawyer.
Your lawyer may challenge the decision of Civi before the court of appeal. This appeal must be made within 1 month of notification of the decision.
