Can an employer object to an employee being sworn on a jury?
Verified 24 March 2026 - Public Service / Directorate of Legal and Administrative Information (Prime Minister)
No. The employer may not prohibit the employee from attending a juror of assizes.
Obligation
This is a obligation a citizen who imposes herself on the employer. The employer's agreement is therefore not necessary.
The employee must, however, inform his employer of his absence by giving him a copy of the notice of meeting as soon as he has received it.
The employer cannot sanction the employee for his absence to perform a jury function (whether it is a disciplinary sanction, of a dismissal, or discriminatory measures).
Remuneration
During his absence, the employee's employment contract is suspended. He then receives no remuneration from his employer.
However, the employee is entitled to a compensation for loss of professional income (on request and on justification to the court or the Assize Court).
