You participate in the review of decisions concerning your career or the functioning of the services, via representatives sitting on advisory bodies. These bodies are the Joint Administrative Commissions (CAP), the Joint Consultative Commissions (CCP) and the Social Committees (SC). We present the composition and functioning of these bodies according to your public service (State - FPE, territorial - FPT, hospital - FPH).

How are the CAPS implemented?
In each ministerial department, one or more CAPS are set up by ministerial decree.
A CAP is established for each category A, B and C of staff.
However, a single CAP may be set up for at least two hierarchical categories where the number of officials under the responsibility of that committee is less than 1 000.
The decree establishing a CAP shall specify the authority with which it is placed (Minister, Director of Headquarters or Head of the decentralized service) and the list of the bodies of civil servants who report to it.
What is the role of CAPS?
The joint administrative committees must be consulted, at the initiative of the administration, on draft individual decision concerning the public servants :
- Advancement to certain grades of category A of an official engaged in a professional activity while on standby
- Individual assessment
- Disciplinary penalty of 2e, 3e or 4e groups
- Termination for abandonment of post
- Dismissal for Professional Insufficiency
- Termination after 3 refusals of proposed positions for reinstatement at the end of an availability
- Refusal of appointment of the probationary official and dismissal for disciplinary misconduct
- Dismissal in the event of refusal of the proposed post(s) for the purpose of resumption of duties at the end of sick leave, long-term sick leave or long-term sick leave if the refusal is not based on a valid reason linked to the state of health
- Dismissal of a teacher after refusal of the proposed position with a view to his reinstatement following his placement in a non-active position to pursue or complete studies of professional interest
- Decision refusing leave for health and safety training to a staff representative on the Social Committee
- Decision denying leave for union formation
- Decision refusing the use of the personal training account for 3 consecutive years
- Decision on renewal or non-renewal of contract of employment of a disabled official
- Refusal for the 2e times of a request for continuing education
- Refusal of a period of professionalization
- Decision to waive the obligation to serve at the end of a vocational training leave
- Refusal of a request for vocational training leave on grounds of operational requirements
- Application for the reinstatement of a civil servant at the end of a period of deprivation of civil rights or a period of prohibition from holding public employment or in the event of reinstatement into French nationality.
CAPS are consulted, in disciplinary training, on draft disciplinary action in groups 2, 3 and 4 with respect to public servants.
A CAP can be consulted, at the request of an official, on the following draft individual decisions:
- Refusal of part-time work, dispute over part-time working conditions
- Refusal to grant leave of absence to attend an administrative competition or continuing education
- Refusal of resignation
- Request for review of the minutes of a annual professional interview
- Refusal of a training request under the Personal Training Account
- Refusal of a 1re request or renewal of telework
- Refusal of a request for time saved in a time savings account
- Decision of the Employer Authority to reclassify for physical incapacity in the absence of the grievor's request.
What is the composition of a CAP?
Each CAP shall comprise, in equal numbers, representatives of the administration and elected staff representatives.
The number of permanent staff representatives depends on the number of officials who report to the Commission:

Each CAP shall comprise a number of alternate staff representatives equal to the number of staff members.
Staff representatives are elected by staff every 4 years.
The representatives of the administration shall be appointed by the authority with which the CAP is placed.
How do CAP meetings take place?
CAPS shall be presided over by the authority with which they are placed.
¾ at least members must be present at the opening of the meeting.
When this number (quorum) is not reached, a new convocation is sent within 8 days to the members of the CAP, who then sits validly if half of its members are present.
The CAP shall deliver its opinions by a majority of the members present.
Where the administrative authority takes a decision which is contrary to the opinion of the CAP, it must inform it of the reasons which led it not to follow that opinion.
Alternate members of the CAP (representatives of the administration and staff) may attend meetings without being able to take part in the discussions. They vote only in the absence of the incumbents they replace.
The President of the CAP may convene experts at the request of the administration or at the request of the staff representatives to be heard on an item on the agenda.
The sessions are not public.
Minutes shall be drawn up after each sitting.
How are CCP set up?
In all public administrations and establishments in the State, one or more joint advisory committees shall be set up by order of the Minister concerned or by decision of the competent authority of the public establishment.
Where the number of contract staff of a public establishment is insufficient to enable the establishment of a CCP, the situation of the staff shall be examined by a CCP of the ministerial department responsible for that establishment designated by order of the minister concerned.
What is the role of the CCP?
The Joint Consultative Commissions (CCP) must be consulted, at the initiative of the administration, on draft individual decision concerning the contract workers :
- Dismissal after the probationary period
- Dismissal for physical incapacity
- Non-renewal of the contract of an agent with a trade union mandate
- Decision denying leave for union formation
- Decision refusing leave for training in health, safety and working conditions to a staff member representing staff on the Social Committee
- Decision refusing training leave for youth managers and facilitators
- Decision refusing a continuing education or a period of professionalization or a vocational training leave
- Decision to waive the obligation to serve at the end of a vocational training leave
- Decision refusing the use of the personal training account for 3 consecutive years
- Application for the reinstatement of an official in the event of the issue of a new residence permit or at the end of a period of deprivation of civil rights or a period of prohibition from holding public employment.
The CCP are consulted, in disciplinary training, on draft disciplinary action other than warning, reprimand and temporary exclusion from duty for a maximum of 3 days.
A CCP can be consulted, at the request of a contract staff member, on the following draft individual decisions:
- Refusal of part-time work, dispute over part-time working conditions
- Refusal to grant leave of absence to attend an administrative competition or continuing education
- Request for review of the minutes of a annual professional interview
- Refusal of a request, in whole or in part, for training under the personal training account
- Application for exemption, total or partial, from a period of professionalization at 1er employment
- Refusal of a 1re request or renewal of telework
- Refusal of a request for time saved in a time savings account.
Where the reclassification for physical incapacity of a member of the contract staff is not possible, CCP shall be informed of the reasons preventing the reclassification.
What is the composition of a CCP?
Each CCP comprises an equal number of elected management and staff representatives.
The number of staff representatives at CCP depends on the number of contract staff reporting to the Commission. It is fixed by ministerial decree for each administration of the State.
Each CCP shall comprise an alternate number of members equal to the number of full members.
Staff representatives are elected by contract staff every 4 years.
The representatives of the administration shall be appointed by the authority with which the CCP is placed.
How do CCP meetings take place?
The organization and functioning of a CCP shall be determined by the decree or decision establishing it.
How are the CSA set up?
One or more social administrative committees shall be established in all public administrations and institutions of the State.
The social committees are set up at ministerial level, at central government level, and in the form of decentralized services.
Social committees are set up in State public institutions and with independent authorities.
Special social committees may be set up in the departments with national jurisdiction or in a central administration department located elsewhere than in the Ile-de-France region.
A social committee may be common to several ministerial departments, to all or some of the public institutions under the same ministerial department.
The social committees are set up by decree.
In administrations that matter at least 200 staff, a specialized training health, safety and working conditions shall be instituted within the social committee.
In administrations less than 200 agents, specialized training can be created where justified by particular occupational risks.
What is the role of the CSA?
The social committees are responsible for examining collective labor issues and working conditions in the administrations in which they are set up.
At least the CSA is debating 1 time per year the programming of its works.
The CSA debates every year :
- The single social report, which serves as a basis for a debate on the development of human resources policies;
- The review of the implementation of the management guidelines on mobility, promotion and promotion of career paths on the basis of individual decisions.
The CSA debates at least once every 2 years general guidance on the following issues:
- Work organization and quality of life policy at work
- Policy for the integration, retention in employment and support of staff with disabilities
- Anticipation of changes in professions, headcount, jobs and recruitment policies
- Support for mobility and professional development projects
- Compensation policy.
The CSA can look at all general questions on the following points:
- Functioning and organization of services
- Impact of the organization on the accessibility of services and the quality of services rendered
- Dematerialization of procedures, technological developments and working methods and impact on staff
- Anti-discrimination policies
- Senior management policies
- Impact of major budget decisions on job management.
Where specialized training on health, safety and working conditions is set up within the Social Committee, that specialized training shall be asked for its opinion on, inter alia:
- Significant transformation of workstations resulting from changes in tools, product changes or work organization
- Changes in the organization and working time, rates and productivity standards related or not to the remuneration of work
- Major projects for the introduction of new technologies and the introduction of these new technologies, where they are likely to have consequences for the health and safety of staff
- Development and updating of the single occupational risk assessment document
- Implementation of measures taken to facilitate the entry, return or retention at work of injured workers and workers with disabilities, including the fitting out of workstations.
Each year, the specialized training is asked for an opinion on an annual program for the prevention of occupational risks and the improvement of working conditions.
What is the composition of a CSA?
The CSA is chaired by the authority with which it is placed. It includes the Director of Human Resources and staff representatives elected for 4 years.
The number of staff representatives depends on the level of expertise of CSA:
- 15 incumbents for a ministerial CSA
- 11 members for a social committee of central administration or a network CSA (competent for central services, decentralized services or national services under the same director-general).
In a social committee for the administration of decentralized services, the maximum number of permanent staff representatives depends on the number of staff, reporting to:

Each committee shall comprise a number of alternate staff representatives equal to the number of members.
For special social administrative committees (possibly created for a particular service), the number of staff representatives shall be 10 staff members and a maximum of 10 alternates.
The number of staff representatives shall be fixed by the decree establishing it.
How do CSA meetings take place?
Each CSA meets at least Twice a year.
The specialized training meet at least 1 time a year.
In the absence of specialized training, the Committee shall meet at least once a year.
At least half of the staff representatives must be present at the opening of the meeting.
When this number (quorum) is not reached, a new invitation is sent within 8 days to the members of CSA, which then sits validly regardless of the number of staff representatives present.
Only the incumbent staff representatives shall vote.
Alternates may attend meetings without being able to take part in the debates. They vote only in the absence of the incumbents they replace.
CSA shall deliver its opinions by a majority of the staff representatives present.
The President of CSA may convene experts to be heard on an item on the agenda.
The sessions are not public.
Minutes shall be drawn up after each sitting.
FPT
How are the CAPS implemented?
A CAP shall be established for each category A, B and C of civil servants at each management center or at each community or institution not affiliated with a management center.
However, a single CAP may be set up for at least two hierarchical categories where the number of officials under this commission is less than 40.
Joint administrative committees may be set up for a municipality and its attached public institutions.
A community or facility that voluntarily affiliates with a management center may continue to operate all or some of the CAPS itself.
What is the role of CAPS?
The joint administrative committees must be consulted, at the initiative of the administration, on draft individual decision concerning the public servants :
- Refusal of tenure and dismissal on probation for disciplinary misconduct
- Termination after 3 refusals of proposed positions for reinstatement at the end of an availability
- Disciplinary penalty of 2e, 3e or 4e groups
- Dismissal for Professional Insufficiency
- Termination of employment in the event of refusal of the proposed post for the purpose of resumption of duties at the end of sick leave, long-term sick leave or long-term sick leave if the refusal is not based on a valid reason related to the state of health
- Refusal of leave for union training
- Decision refusing leave for health and safety training to a staff representative on the Social Committee
- Decision refusing the use of the personal training account
- Refusal for the 2e consecutive to a request for advanced training or preparation for a competition or a request for personal training or learning of the French language
- Decision on renewal or non-renewal of contract of employment of a disabled official
- Decisions on unemployment benefit
- Application for the reinstatement of a civil servant at the end of a period of deprivation of civil rights or a period of prohibition from holding public employment or in the event of reinstatement into French nationality.
CAPS are consulted, in disciplinary training, on draft disciplinary action in groups 2, 3 and 4 with respect to public servants.
A CAP can be consulted, at the request of an official, on the following draft individual decisions:
- Request for review of the minutes of a annual professional interview
- Refusal of resignation
- Refusal of part-time work, dispute over part-time working conditions
- Refusal to use the personal training account
- Refusal of a 1re request or renewal of telework
- Refusal of a request for time saved in a time savings account
- Decision of the Employer Authority to reclassify for physical incapacity in the absence of the grievor's request.
What is the composition of a CAP?

Where the territorial authority takes a decision that is inconsistent with the opinion of the CAP, it shall inform the territorial authority of the reasons for not following that opinion.
Alternate members of the CAP (representatives of the administration and staff) may attend meetings without being able to take part in the discussions. They vote only in the absence of the incumbents they replace.
The President of the CAP may convene experts at the request of the administration or at the request of the staff representatives to be heard on an item on the agenda.
The sessions are not public.

How are CCP set up?
A joint advisory commission (CCP) shall be set up at each management center or at each community or establishment not affiliated with a management center.
What is the role of the CCP?
The Joint Consultative Commissions (CCP) must be consulted, at the initiative of the administration, on draft individual decision concerning the contract workers :
- Dismissal after the probationary period (except in the case of an employee of a firm, an employee of a group of elected officials or a group of delegates or a functional managerial position)
- Non-renewal of the contract of an agent with a trade union mandate
- Dismissal for physical incapacity
- Decision refusing leave for training in health, safety and working conditions to a staff member representing staff on the Social Committee
- Decision denying leave for union formation
- Decision refusing the use of the personal training account for 3 consecutive years
- Decision refusing for the 2e Consecutive training for further training, preparation for public service professional examinations and competitions, personal training, training to combat illiteracy and for learning the French language.
The CCP are consulted, in disciplinary training, on draft disciplinary action other than warning, reprimand and temporary exclusion from duty for a maximum of 3 days.
A CCP can be consulted, at the request of a contract staff member, on the following draft individual decisions:
- Refusal of part-time work, dispute over part-time working conditions
- Request for review of the minutes of a annual professional interview
- Refusal of a training request under the Personal Training Account
- Refusal of a 1re request or renewal of telework
- Refusal of a request for time saved in a time savings account.
What is the composition of a CCP?

When this number (quorum) is not reached, a new invitation is sent within 8 days to the members of the CCP, which then sits validly without a quorum condition.
The CCP shall deliver its opinions by a majority of the votes cast.
Where the territorial authority takes a decision contrary to the opinion issued by the CCP, it must inform it within one month of the meeting of the reasons which led it not to follow that opinion.
Alternate CCP members (administrative and staff representatives) may attend meetings without being able to take part in the discussions. They vote only in the absence of the incumbents they replace.
The President of the CCP may convene experts at the request of the administration or at the request of staff representatives to be heard on an item on the agenda.
The sessions are not public.

How are CSTs implemented?
A Territorial Social Committee (TSC) is established in each community or institution employing at least 50 staff or in each management center for affiliated communities and institutions employing fewer than 50 staff.
A common CST may be set up, by consensus, by a local authority and one or more public institutions attached to it or by a public inter-municipal cooperation institution and all or part of the member municipalities, if the total number of employees employed is at least 50.
In communities and public institutions employing at least 200 staff, a specialized training health, safety and working conditions shall be instituted within the social committee.
In communities and institutions less than 200 agents, a specialized training health, safety and working conditions can be created where justified by particular occupational risks.
In addition to specialized training in health, safety and working conditions, other training may be instituted for part of the services of the community or establishment, if the existence of particular occupational risks so warrants.
What is the role of CST?
The social committees are responsible for examining collective labor issues and working conditions.
At least the CSE is debating 1 time per year the programming of its works.
In particular, the CST shall be consulted on:
- Draft decisions on the operation and organization of services
- Draft human resources management guidelines
- Draft action plan on professional equality between men and women
- Strategic directions for compensation schemes
- Draft training plan
- Strategic guidelines for social action and supplementary social protection aid
- Major fit-out projects that modify health and safety conditions and working conditions when they are part of a service reorganization project
- Establishment of criteria for assessing professional worth
- Rules on working time and time savings account.
The CST debates annually on the following points:
- Review of the implementation of the management guidelines
- Evolution of human resources policies
- Creation of non-full-time jobs
- Dematerialization of procedures, technological developments and working methods and impact on staff
- Policy of integration, retention in employment and support for the career paths of workers with disabilities.
Where specialized training on health, safety and working conditions is set up within the Social Committee, that specialized training shall be asked for its opinion on, inter alia:
- Protection of the health, hygiene and safety of workers in their work
- Organization of work
- Teleworking
- Disconnection and devices for regulating the use of digital tools
- Improvement of working conditions
- Development and updating of the single occupational risk assessment document
- Significant transformation of workstations resulting from changes in tools, product changes or work organization
- Changes in the organization and working time, rates and productivity standards related or not to the remuneration of work
- Major projects to introduce new technologies.
It shall be asked for its opinion on the implementation of measures to facilitate the entry, return or retention at work of workers who have been injured at work and on duty and of workers with disabilities, in particular the fitting-out of workstations.
It shall also be consulted on general measures to enable the reclassification of staff found unfit to perform their duties.
Each year, it is asked for its opinion on an annual program for the prevention of occupational risks and the improvement of working conditions and the information on health, safety and working conditions contained in the single social report.
Please note
If no specialized training has been instituted within the CSE, the CSE performs the tasks of the specialized training.
What is the composition of a CST?
The CSE is chaired by the territorial authority or the president of the management center.
A CSE placed with a community or public institution shall include representatives of the administration appointed by the territorial authority from among the members of the deliberative assembly or among the agents of the community or institution.
The CSE placed with a management center shall include representatives of the administration appointed by the president of the management center from among:
- Elected officials from the local authorities and affiliated establishments employing less than 50 agents, after consulting the members of the board of directors from these local authorities and establishments
- And community and affiliated institution agents employing fewer than 50 agents or management center agents.
The number of staff representatives shall be fixed within the following limits:

FPH
How are the CAPS implemented?
The hospital corps of staff are governed by 10 separate joint administrative committees:
- 4 commissions for category A bodies
- 3 commissions for category B bodies
- 3 commissions for category C bodies.
The list of staff members of each of these committees shall be determined by ministerial order.
A local CAP (CAPL) is set up by the deliberative assembly of an institution, as soon as the number of civil servants reporting to this commission is at least equal to 4 for 3 consecutive months.
When a local CAP cannot be set up, civil servants are subject to a departmental CAP (CAPD) set up by theARS: titleContent and managed by an establishment located in the department.
Reminder
A National CAP (NPC) is set up for each category A management body recruited and managed at national level.
What is the role of CAPS?

- Termination of employment in the event of refusal of the proposed post for the purpose of resumption of duties at the end of sick leave, long-term sick leave or long-term sick leave if the refusal is not based on a valid reason related to the state of health

Where a head of establishment takes a decision which is contrary to the opinion of the CAP, he must inform him of the reasons which led him not to follow that opinion.
Alternate members of the CAP (representatives of the administration and staff) may attend meetings without being able to take part in the discussions. They vote only in the absence of the incumbents they replace.
The President of the CAP may convene experts at the request of the administration or at the request of the staff representatives to be heard on an item on the agenda.

How are CCP set up?
A Joint Consultative Commission (CCP) is set up in each department by theARS: titleContent which entrusts its management to one of the establishments whose head office is in the department.
What is the role of the CCP?
The Joint Consultative Commissions (CCP) must be consulted, at the initiative of the administration, on draft individual decision concerning the contract workers :
- Dismissal
- Non-renewal of the contract of an agent with a trade union mandate
- Decision denying leave for union formation
- Decision refusing leave for training in health, safety and working conditions to a staff member representing staff on the Social Committee
- Decision refusing use of personal training account for the 3e consecutive times
- Decision refusing for the 2e consecutive training included in the training plan
- Decision refusing a period of professionalization
- Decision refusing for the 3e consecutive time on vocational training leave
- Decision to waive the obligation to serve at the end of a vocational training leave
- Application for the reinstatement of an official in the event of the issue of a new residence permit or at the end of a period of deprivation of civil rights or a period of prohibition from holding public employment.
The CCP are consulted, in disciplinary training, on draft disciplinary action other than warning, reprimand and temporary exclusion from duty for a maximum of 3 days.
A CCP can be consulted, at the request of a contract staff member, on the following draft individual decisions:
- Refusal of part-time work, dispute over part-time working conditions
- Decision refusing leave of absence to attend an administrative competition or continuing education
- Request for review of the minutes of a annual professional interview
- Refusal of a training request under the Personal Training Account
- Application for exemption, total or partial, from a period of professionalization at 1er employment
- Refusal of a 1re request or renewal of telework
- Refusal of a request for time saved in a time savings account
- Decision refusing unpaid leave for family reasons, leave to start or resume a company, mobility leave.
What is the composition of a CCP?
Each CCP comprises, in equal number, elected management and staff representatives.
The number of staff representatives in CCP depends on the number of staff reporting to the Commission:

Each CCP shall comprise a number of alternate staff representatives equal to the number of staff members.
Staff representatives shall be elected by contract staff every 4 years.
The representatives of the administration shall be appointed by the head of the institution to which CCP is placed, from among the category A staff members serving in the institutions of the department.
How do CCP meetings take place?
The CCP are at least meeting Twice a year.
¾ at least members must be present at the opening of the meeting.
When this number (quorum) is not reached, a new invitation is sent within 8 days to the members of the CCP, which then sits validly regardless of the number of members present.
The CCP issues its opinions by a majority of the votes cast, except when they sit on disciplinary matters. In this case, its opinion is required by a majority of the members present.
When the head of establishment takes a decision that is contrary to the opinion issued by the CAP, he must inform him of the reasons which led him not to follow that opinion.
Alternate CCP members (administrative and staff representatives) may attend meetings without being able to take part in the discussions. They vote only in the absence of the incumbents they replace.
The sessions are not public.
Minutes shall be drawn up after each sitting.
How are the CSE set up?
A social establishment committee shall be set up in each hospital and in the health cooperation groups of means governed by public law.
In establishments employing at least 200 staffspecialized training in health, safety and working conditions shall be established within the Social Committee.
In establishments with fewer than 200 staff, specialized training in health, safety and working conditions may be created if justified by particular occupational risks.
What is the role of the CSE?
The CSE debates annually on the programming of the works of the forum and on the the evolution of human resources policies.
In particular, CSE shall be consulted on:
- Draft rules and regulations of the establishment
- Service Reorganization Projects
- Draft comprehensive multi-year funding plan
- Accessibility of services and quality of services rendered (except for quality of care and matters falling within the remit of the medical establishment commission, the users commission and the nursing, rehabilitation and medico-technical commission)
- Major fit-out projects that modify health, safety and working conditions when they are part of a service reorganization project
- Service Reorganization Projects
- Projects relating to the reception and integration of professionals and students
- Draft management guidelines
- Projects relating to the general staff training policy
- Draft decisions on working time.
Specialized training on health, safety and working conditions shall be consulted on, inter alia:
- Protection of the health, hygiene and safety of workers in their work
- Organization of work
- Teleworking, disconnection and devices for regulating the use of digital tools
- Improvement of working conditions
- Significant transformation of workstations resulting from changes in tools, product changes or work organization
- Changes in the organization and working time, rates and productivity standards related or not to the remuneration of work
- Major projects to introduce new technologies that could have consequences for the health and safety of officers
- Implementation of measures taken to facilitate the entry, return or retention at work of injured workers and disabled workers.
It shall be informed of the visits and of all observations made by the occupational health and safety inspector and of the administration's responses to those observations.
It examines the annual report prepared by the occupational physician.
Please note
Where no specialist training has been established within CSE, CSE shall carry out the tasks of the specialist training.
What is the composition of a CSE?
The CSE is chaired by the director of the institution or the administrator of the group.
It also includes 1 representative of the medical commission of establishment.
The number of staff representatives shall be fixed within the following limits:

Each committee shall comprise a number of alternate staff representatives equal to the number of members.
The specialized training includes representatives of the medical staff, pharmacists and odontologists.
How do CSE meetings take place?
Each CSE meets at least 1 time per quarter, specialized training as well.
At least half of the staff representatives must be present at the opening of the meeting.
When this number (quorum) is not reached, a new invitation is sent within 8 days to the members of CSE, which then sits validly regardless of the number of staff representatives present.
Only staff representatives shall take part in the vote.
Alternates may attend meetings without being able to take part in the debates. They vote only in the absence of the incumbents they replace.
CSE shall deliver its opinions by a majority of the staff representatives present.
The President of CSE may convene experts to be heard on an item on the agenda.
The sessions are not public.
