Separation of parents: who can receive child support?

The following individuals may receive support:

  • A separate parent to insure maintenance of the child of which he has custody. The parent may perceive a child support on the part of the other parent, whether the residence is fixed at home or alternating between the two parents. This pension is used to cover the basic needs of the child, but also the expenses related to his education.
  • The adult child whose parents are separated may receive support directly. In this situation, the creditor of the pension remains the parent who bears the child's primary material burden, but it is the child who receives the money. The pension is payable for a child of full age as long as the child is unable to support himself (e.g. a child pursuing higher education).
  • A husband in the event of de facto separation, body separation or as an interim measure in a divorce proceedings. The spouse may receive maintenance from the other spouse in respect of the duty of relief. This pension is not for the children, but for the needs of the beneficiary spouse.

Maintenance may be provided enter descendants and ascendants (in both directions). This maintenance obligation covers the essential needs of the creditor (housing, food, clothing).
