Can a child support amendment be requested if the other parent's salary increases?

Yes, the amount of support can be revised if income of the parent who pays it (called the debtor) change in a significant way.
Generally speaking, a parent can apply for a change in support
- if a new item intervened in the income or the loads of parents
- or if the needs of the child have evolved.
Warning
The review of the amount of maintenance shall not not to be confused with the annual revaluation of maintenance. Revaluation occurs when the judgment, divorce agreement or parental agreement provides for a indexing clause to monitor the evolution of a consumer price index.
The amount of support may be reviewed amicably between the parents. To reach an agreement, parents may request a family mediation.
The agreement reached between the parents can be formalized in a parental agreement. Two models are available:
Model parental agreement - Residence and access and accommodation
Model parental agreement - Alternate residence
In case of disagreement, one of the parents may seize Jaf: titleContent of a application for review of maintenance.
The request can be made using a form:
Application to the family court judge (parental authority, access rights, maintenance, etc.)
In its query, the parent shall, in particular specify new item justifying an amendment to the maintenance previously fixed.
The Jaf competent to receive the application shall be that of the place of residence of the parent with whom the minor child habitually resides.
If the application relates solely to maintenance, the competent Jaf shall be that of the place of residence of the parent who is primarily responsible for the minor or adult child.
