ESC benefits: end of the seniority criterion

Following a ruling by the Court of Cassation, the Urssaf now prohibits access to the services of the Economic Social Committee (CSE) from being subject to a condition of seniority. The ESCs must comply before the end of the year.

In a judgment of 3 april 2024, the Court of Cassation ruled that an ESC cannot make the benefit of social and cultural activities conditional on a period of seniority.

In fact, new employees were required to serve six months in order to benefit from these activities. According to the Court, this constituted discrimination.

Following this case-law, the Urssaf states that the CSEs have until 31 December 2025 to comply.

An adjustment of contributions may be made by the Urssaf in the event of non-compliance.

Reminder

The social and cultural activities of the EESC are exempt from social contributions.
