Comment faire ?

In any case:

  • Passport: pages concerning civil status and date of validity
  • Criminal record of the country of origin translated into French, in case of residence outside France of the applicant
  • Evidence, if necessary, of compliance with the regulatory conditions for the exercise of the profession and/or commercial, industrial, craft or liberal activity
  • Certificate of registration in the National Register of companies (RNE) less than 6 months old, if the activity is already registered at the time of application.

Creation of activity (individual business or business)

The documents differ depending on the situation:

Taking over a business
  • Presentation on free paper of the creation project, the business plan and a multi-annual provisional budget and any supporting documents to consolidate the business plan
  • Statement of credit balance (in euros or dollars), of an account in the name of the applicant opened with a credit institution either having its registered office within the European Central Bank or approved by the European Prudential Supervision and Resolution Authority
  • Document justifying the regular or future use of premises allocated to the exercise of the activity
  • Justification, if necessary, relating to the material means essential to the exercise of the planned activity whether they are already acquired or rented, or whether they are the subject of a certain and imminent acquisition or rental
  • Document proving the applicant's qualification and/or experience in relation to the activity
  • Promise or contract of sale of the fund
  • Last balance sheet and possibly the last simplified income statement of the previous operator.
Lease management
  • Presentation on free paper of the creation project, the business plan and a multi-annual provisional budget, and any supporting documents to consolidate the business plan
  • Statement of credit balance (in euros or dollars), of an account in the name of the applicant opened with a credit institution either having its registered office within the European Central Bank or approved by the European Prudential Supervision and Resolution Authority
  • Document justifying the regular or future use of premises allocated to the exercise of the activity
  • Justification, if necessary, relating to the material means essential to the exercise of the planned activity whether they are already acquired or rented, or whether they are the subject of a certain and imminent acquisition or rental
  • Document proving the applicant's qualification and/or experience in relation to the activity

  • Last balance sheet and possibly the last simplified income statement of the previous operator.
Business of French law
  • Presentation on free paper of the creation project, the business plan and a multi-annual provisional budget and any supporting documents to consolidate the business plan
  • Statement of credit balance (in euros or dollars), of an account in the name of the applicant opened with a credit institution either having its registered office within the European Central Bank or approved by the European Prudential Supervision and Resolution Authority
  • Document justifying the regular or future use of premises allocated to the exercise of the activity
  • Justification, if necessary, relating to the material means essential to the exercise of the planned activity, whether they are already acquired or leased, or whether they are the subject of a certain and imminent acquisition or lease
  • Document proving the applicant's qualification and/or experience in relation to the activity
  • Draft statutes or statutes of the business showing the draft share capital allocation.
Business governed by French law, subsidiary of a foreign business
  • Presentation on free paper of the creation project, the business plan and a multi-annual provisional budget and any supporting documents to consolidate the business plan
  • Statement of credit balance (in euros or dollars), of an account in the name of the applicant opened with a credit institution either having its registered office within the European Central Bank or approved by the European Prudential Supervision and Resolution Authority
  • Document justifying the regular or future use of premises allocated to the exercise of the activity
  • Proof, if necessary, of the material means essential to the exercise of the planned activity, whether they are already acquired or leased, or whether they are the subject of a certain and imminent acquisition or lease;
  • Document proving the applicant's qualification and/or experience in relation to the activity
  • Proof (in French) of appointment or, if applicable, a letter of intent from the body competent for appointment
  • Statutes of the legal person governed by foreigners law, and, if necessary, an extract of registration or equivalent issued by the competent authority of the country of origin, accompanied by their translation into French by a certified translator
  • Draft articles of association or the articles of association of the business showing the draft terms for the allocation of share capital.
Establishment of a foreign legal person
  • Presentation on free paper of the creation project, the business plan and a multi-annual provisional budget and any supporting documents to consolidate the business plan
  • Statement of credit balance (in euros or dollars), of an account in the name of the applicant opened with a credit institution either having its registered office within the European Central Bank or approved by the European Prudential Supervision and Resolution Authority
  • Document justifying the regular or future use of premises allocated to the exercise of the activity
  • Justification, if necessary, relating to the material means essential to the exercise of the planned activity, whether they are already acquired or leased, or whether they are the subject of a certain and imminent acquisition or lease
  • Document proving the applicant's qualification and/or experience in relation to the activity
  • Proof of appointment or a letter of intent from the body responsible for the appointment
  • Statutes of the legal person governed by foreigners law, and, if necessary, an extract of registration or equivalent issued by the competent authority of the country of origin, accompanied by their translation into French by a certified translator
  • Last accounting statement and possibly the simplified income statement of the foreign legal person, accompanied by their translation into French by an approved translator.
Activity created for more than 1 year
  • Presentation on free paper of the creation project, the business plan and a multi-annual provisional budget and any supporting documents to consolidate the business plan
  • Statement of credit balance (in euros or dollars), of an account in the name of the applicant opened with a credit institution either having its registered office within the European Central Bank or approved by the European Prudential Supervision and Resolution Authority
  • Document justifying the regular or future use of premises allocated to the exercise of the activity
  • Justification, if necessary, relating to the material means essential to the exercise of the planned activity whether they are already acquired or rented, or whether they are the subject of a certain and imminent acquisition or rental
  • Document proving the applicant's qualification and/or experience in relation to the activity
  • Company tax status report (P 237)
  • Last balance sheet and possibly the simplified income statement of the company
  • If the applicant is an employee: pay slips for the last 3 months
  • If the applicant is not an employee: extract from the account book establishing the remuneration paid in the last 3 months
  • If the applicant is self-employed: monthly or quarterly URSSAF declaration of turnover if the applicant is self-employed.

Inserting into a business

  • Company tax status report (P 237)
  • If the applicant is mentioned in the statutes: copy of the statutes of the company
  • If the applicant is not mentioned in the statutes: proof of the appointment or, possibly, a letter of intent from the body competent for the appointment
  • If the applicant has the status of employee: copy of the employment contract
  • If the applicant does not have the status of employee: any certified accounting evidence of the capacity of the company to provide the applicant with income at least equivalent to Smic: titleContent full-time.

Once the request is confirmed, it is possible to download, via the confirmation screen, a deposit confirmation. This will also be sent by email.

Once the investigation is completed, the decision will be addressed by mail.
