As an adopter, you must include the following documents with your application:

  • Accreditation issued by your department's child welfare department if the child is a ward of the government or is handed over to a licensed adoption agency or is a foreigner
  • Full copy of your birth certificate less than 3 months old
  • Full copy less than 3 months old of the adopted person's birth certificate less than 3 months old
  • Full copy less than 3 months old of your children's birth certificate if you have one
  • Photocopy of your family booklet and that of the adopted (marriage pages and children pages even if these pages are blank)
  • Full copy less than 3 months old of your marriage certificate or copy of your marriage certificate Civil partnerships: titleContent, if you are concerned
  • Full copy less than 3 months old of the birth certificate of your partner or Civil partnership partner, if you are concerned
  • Consent to adoption by the adoptee's parents, not deprived of their parental rights, made before a notary or before a French consular or diplomatic agent, or before the child welfare service that took in the child. If it is not possible to provide parental consent, please indicate all company due diligence to try to locate them.
  • Death certificate if the adopted person's parents have died
  • Copy of the court decision if the parents have lost their rights of parental authority as a result of this decision
  • Consent to adoption by the family council or the ward family council of the State of the department in the event that the adopted person has no established parentage, or when both parents are unable to manifest their will or have lost their rights of parental authority
  • Copy of the judicial decision declaring the child abandoned if the child was judicially declared in a situation of parental neglect
  • If you are married, your spouse's consent is given before a notary or a consular or diplomatic agent
  • Consent to the adoption of the adopted person if he or she is over 13 years of age before a notary or a French consular or diplomatic agent, or before the child welfare service that took in the child
  • Acts of non-withdrawal of consents required at the expiry of a period of 2 months
  • Details on the choice of the adopted person's surname
  • Consent of the adopted person to change his or her first name if he or she is over thirteen years of age
  • Certification on honor that the adoption requested is not likely to compromise family life if you already have one or more children
  • If you are married, the sworn statement that you are “neither legally separated, nor divorced, nor in the process of divorce”
  • Advice from your adult children about the adoption project. If your children are minors, please specify their age and the relationship with the adopted child.

If you are a foreign national, you must attach the certificate of custom, relating to the national law of the country of which you are a national, on adoption, issued by the consulate or by a lawyer of that country.

If you are domiciled abroad after your marriage, you must attach the certificate of custom, relating to the law, in matters of adoption, of the country of your domicile after marriage, issued by the consulate or by a lawyer of that country.

If the adopted child is a minor foreigner, you must attach the double-sided copy (two sides) of his/her proof of identity and the certificate of custom issued by the consulate or a lawyer of the country of which he/she is a national proving that the personal law of the child does not prohibit his/her full adoption (this does not concern the minor foreigner born and residing in France).

Et après ?

The hearing, if the judge deems it useful, takes place in council chamber. You are summoned by post or by email to the address indicated in your request.

At the hearing, the judge hears your explanations, examines the documents provided to him and asks the questions he considers useful.

Its task is to verify that the conditions for adoption are met and that it is in the best interests of the adopted child.

The judgment shall be delivered in open court.

You receive a copy of the decision rendered, by the Registry of the Judicial Tribunal.
