The adopters shall attach to the application the documents following:

  • Consent to the adoption of the adopted act before a notary or before a French consular or diplomatic agent
  • Opinion of the person responsible for the legal protection measure with representation relating to the person on the appropriateness of the draft adoption if the adopted person is the subject of such a protection measure and is unable to consent personally to his own adoption
  • Full copies less than 3 months old of adoptive birth certificates (or less than 6 months if issued by a foreign authority)
  • Full copy less than 3 months old of the adopters' marriage certificate if they are married (or less than 6 months old if the certificate is issued by a foreign authority)
  • Copy of the receipt of the joint declaration of Civil partnerships of the adopters if they are passed
  • Certificate of cohabitation of adopters issued in town hall if they live in cohabitation or any other documents attesting to the cohabitation (third party certificates, production of a lease mentioning the two tenants ...)
  • Full copy less than 3 months old of the adopted child's birth certificate (or less than 6 months if the birth certificate is issued by a foreign authority)
  • Full copy less than 3 months old of the birth certificate of the children of the adopters if they have one (or less than 6 months if the certificate is issued by a foreign authority)
  • Photocopy of the adoptive parents' and adoptive parents' family booklets (marriage pages and children's pages even if they are blank)
  • Details on the choice of the adopted person's name
  • Consent of the adopted person to change his/her name if requested (addition or substitution of the name of the adopter to that of the adopted person). This consent can be made on free paper.
  • Statement by the adopters that they are “neither separated, nor separated, nor divorced, nor in the process of divorce”
  • Affirmation on the honor of the adoptive parents that the adoption requested is not likely to jeopardize family life if they already have one or more children
  • Advice of the adult children of adopters on the proposed adoption. If the children of the adoptive parents are minors, their age and the relationship with the adopted child should be specified.

If the adopted adult is married or linked by a Civil partnership :

  • Full copy less than 3 months old of the marriage certificate if the adopted adult is married (or less than 6 months old if the certificate is issued by a foreign authority)
  • Copy of Civil partnership certificate if adopted adult has a Civil partnership
  • Full copy less than 3 months old of the birth certificate of the adopted adult's Civil partnership or partner, if married or married (or less than 6 months old if issued by a foreign authority)
  • Single letter from the adoptee's Civil partnership partner or partner commenting on the project with a double-sided copy (both sides) of their proof of identity

If the adopted adult has children :

  • Full copy less than 3 months old of the birth certificate of the adopted adult's child(ren), if any
  • Consent of the adopted person's children, if they are over 13 years of age, to change their name

The court can always request additional documents, depending on the personal situation of the adoptive parent.

Et après ?

The hearing, if the judge deems it useful, takes place in council chamber. You are summoned by mail or by email to the address indicated in your request.

At the hearing, the judge hears your explanations, examines the documents submitted to him and asks the questions he considers useful.

Its task is to verify that the conditions for adoption are met and that it is in the best interests of the adopted adult.

The judgment shall be delivered in open court.

You receive a copy of the decision rendered, by the Registry of the Judicial Tribunal.
