Et après ?
The Fiva acknowledges receipt of the request within 15 days following the submission of the file. He tells the victim that his file is complete. If he is not, he can ask him for additional documents (throughout the investigation of the case).
If the Fiva deems it necessary, the victim may be received by an expert doctor, at the expense of the Fiva.
The Fiva: titleContent must make an offer of compensation within 6 months from the date of submission of the request.
If the offer is accepted, compensation must be paid within 2 months upon receipt of the victim's consent and the documents allowing payment (example: RIBS: titleContent).
The Fiva's decision can be challenged if the victim is in any of the following cases:
- It considers that the offer of compensation is insufficient in relation to the damage suffered
- The Fiva refused the claim for compensation (explicit decision to refuse)
- Fiva did not reply within 6 months (implicit refusal).
