Are you adopting the child of your Civil partnership, partner or partner, and want to know if that child can bear your name? The choice of surname are different between simple and plenary adoption. We present you the information you need to know about the name of a minor adopted by the person living in a relationship with one of the minor's parents.

Adoption creates a link of parentage between the adopter and the adopted. Adoption may be single or full.

In the case of simple adoption, the links with the family of origin are maintained.

In the case of adoption by the plenaryYes, there's a total failure the adopted person's ties to his or her family of origin.

Simple adoption

Possible name choices

The adopted person may take one of the names following:

  • Name of the adoptee + name of the adopter. The order of the names is free within the limit of a single name for each of them in the case of double names.
  • Name of the adopted.

Example :

Fabien Caron adopts Nathan Veron, son of his concubine.

Nathan's last name can be: Veron Caron or Caron Veron or Veron.

Example :

Theophile Gautier Dumas adopts Kévin Monceau Dupont, son of his wife.

Kevin can be given one of the following names: Monceau Gautier or Gautier Monceau or Monceau Dumas or Dumas Monceau or Dupont Dumas or Dumas Dupont or Dupont Gautier or Gautier Dupont or Gautier Dumas or Monceau Dupont.

Please note

In the context of the simple adoption of the child of the other member of the couple, it is not possible to substitute the name of the adoptive parent for that of the adopted. 

After a simple adoption, when the name of the adopter is added to the name of the adopted person, the new name of the adopted person constitutes a indivisible compound name. It is therefore transmitted in full to the descendants.

Minor 13 years of age and over

The adopter shall collect the consent adopted person if he's 13 and over.

The adopter shall indicate in his application for adoption the name chosen for the adopted child.

If the adopted person is 13 years of age or older, the application must indicate that he or she has given his or her consent.

The request is done on free paper or using the form cerfa no. 15741.

The choice of the adopted person's name after the adoption procedure is possible if the following conditions are met:

  • The adopter wishes the adopted person to retain his or her original name
  • The adopter did not make this request at the adoption proceeding.

The consent of the adopted child is required if he or she is 13 years of age or older.

The application is to be made to the court of law which has been responsible for the adoption procedure.

FYI  

The adopter may apply to the court for a change of first name(s) of the adopted. If the adopted person is 13 years of age or older, the motion for adoption must indicate that he has given his consent.

In the absence of a choice or in the event of disagreement, the court responsible for the adoption procedure shall decide on the name of the adopted person.

The 1er name of the adopter is added in 2of position at 1er adopted person's name.

Example :

Theophile Gautier Dumas adopts Kévin Monceau Dupont, son of his concubine.

Kevin's last name is Monceau Gautier.

When the simple adoption procedure is completed, the adopter may apply for the renewal of the identity card and/or the passport of the minor.

The adopter may also inform the authorities and bodies concerned by the new name of the adopted minor: sickness insurance, mutual insurance...

1st child

The adopter and the other member of the couple may choose one of the following names:

  • Either the name of one of them, or a single word of the double name of one of them
  • Let their two names be placed side by side, in the order chosen by them, and within the limit of one surname for each of them in the case of a double name.

The choice of a child's name cannot be exercised only once.

Example :

Name of the adopter: Dupond Durand

Child's parent name: Dupuis

Name of child after adoption: Dupond Durand or Dupuis or Dupond Dupuis or Durand Dupuis or Dupuis Dupond or Dupuis Durand or Dupond or Durand

Subsequent Children

The name given to the 1er common child of the couple, irrespective of the way in which his or her parentage, must be given to the following children of the couple.

Example :

Eric Dupond Durand and Fanny Dupuis have a child born on 1er october 2022 or adopted a child by plenary adoption by judgment of 1er October 2022. They choose the name Dupuis Dupont for this child.

Eric Dupond Durand adopts Fanny Dupuis' son on January 4, 2024. That child must be called Dupuis Dupont.

At the same time, the court shall rule on the motion for full adoption and the name change.

You can make the joint declaration of choice of name in 2 ways:

  • On the form cerfa no. 15743. This form allows you to make the request for adoption and the declaration of choice of name.
  • On free paper. The declaration of choice of name shall be attached to the application for adoption.

The adopter may apply to the court for a change of first name(s) of the adopted. If the adopted person is 13 years of age or older, the motion for adoption must indicate that he has given his consent.

In the absence of a joint declaration indicating the choice of the child's name, the court responsible for adoption procedure pronounces on the child's name.

The child takes the name of the adopter and the other member of the couple, within the limit of 1er name for each of them, in the case of double names, in alphabetical order.

Example :

Name of the adopter: Avril Marion

Child's parent name: Gautier Diallo

Name of adopted child: Avril Gautier

When the plenary adoption procedure is completed and a new birth certificate has been issued, the adopter and the other member of the couple may apply for the renewal of the identity card and/or the passport of the minor.

The adopter and the other member of the couple may also inform the administrations and bodies concerned by the new name of the adopted minor: health insurance, mutual insurance...
