Asbestos early retirement for a public servant

Are you a civil servant or a contract worker (or a former civil servant or contract worker) and have been diagnosed with an occupational disease caused by asbestos? Do you work or have you worked in an establishment where asbestos or asbestos-containing materials were treated? You can, under certain conditions, stop your activity early and receive a specific early retirement allowance (Ascaa) until you retire. We present you the information to know.

The rules differ depending on whether you are (or were) a civil servant or a contract worker.

Public servant

You can stop your activity early and receive a specific early retirement allowance (Ascaa) until you retire if you are in one of the following situations:

1er cases

You can stop your activity from 50 years old if you are recognized affected by a occupational disease caused by asbestos, contracted during your employment in the public service.

2e cases

You can stop your activity if you are official or former official of the ministry of defense and if you fill the following 2 conditions :

You may cease your activity from an age equal to 60 years minus one third of the total period during which you have exercised the function listed by ministerial decree and at the earliest at age 50.

3e cases

You can stop your activity if you are official or former official of the ministry responsible for the sea and if you fill the following conditions :

You may cease your activity from an age equal to 60 years minus one third of the total period during which you have exercised the function listed by ministerial decree and at the earliest at age 50.

In order to benefit from the early cessation of activity and the specific allowance, you must submit a request to your administration or your former administration.

Your application must be accompanied by the necessary supporting documents.

If you are no longer a civil servant at the time of your application, you are entitled to social security under the same conditions as would apply to you if you were a civil servant. You are re-affiliated to the social security scheme that you enjoy as a civil servant.

Your administration informs you of its decision within 2 months following the date of receipt of your complete file.

You can stop your activity from 1er day of the month following the date of receipt of the admission decision of your administration.

From that date until your retirement, you can no longer work. Only artistic or creative activity is possible. If you engage in any other unauthorized activity, the payment of the specific allowance is suspended and any allowances already received are claimed.

From the time you leave the company and until you retire, you receive a specific early retirement allowance (Ascaa).

The amount of this allowance is calculated on the basis of a reference remuneration equal to the average of your gross monthly remuneration of your last 12 months of activity.

The amount of the allowance is equal to 65% of that reference remuneration.

This amount is revalued based on the increase in the value of the public service index point.

The compensation elements taken into account in the calculation of the average of your gross monthly compensation for your last 12 months of activity are the usual and regular elements that are paid to you.

Refunds of expenses are not taken into account.

In the case of an overseas or foreign assignment, the remuneration elements related to that assignment are taken into account only if you continue to reside overseas or abroad and have the center of your moral and material interests there.

If you were on sick leave (regular, long-term or long-term) on half-pay before you stopped working, the amount of the specific allowance is calculated on the basis of the average of your full-time pay. The same applies if you were part-time.

The amount of the specific allocation may not be less than €1,351.30 gross per month, not less than €1,367.27 gross per month.

The amount of the specific allowance may not be higher than the gross index salary that you had before you ceased to be active.

The specific allowance is paid to you each month at term expired by your last public employer.

The specific allowance is subject to sickness and pension contributions.

Your pension contributions SRE: titleContent or to the CNRACL: titleContent and to the RAFP: titleContent are supported by your administration.

They are calculated on the basis of the index salary and the premiums you held before you left business.

The specific allocation is also subject to CSG: titleContent and CRDS: titleContent.

When you are entitled to a full pension and no earlier than age 60

You are compulsorily retired and the specific allowance ceases to be paid to you when you have the number of quarters of pension insurance required to be entitled to a full pension and no earlier than age 60.

Warning  

If you are an active public servant, the number of quarters of pension insurance required to qualify for a full pension is different.

No later than age 65

You must be retired no later than age 65 even if you don't have the number of quarters of pension insurance required to qualify for a full-rate pension.

In this case, your retirement pension is granted at full rate (i.e. without discount).

The haircut is a reduction that is applied to the amount of the retirement pension in the event of retirement before age 65 without having the number of quarters of pension insurance required to be entitled to a full rate pension.

At your request from the age of 60 if you accept a pension with discount

You can apply to retire as soon as you turn 60, regardless of the number of quarters you have.

If you do not have the number of quarters of pension insurance required to qualify for a full pension, your pension is subject to a discount.

If you retire without having the required number of quarters of pension insurance and without waiting until you turn 65, your pension is reduced by 1.25% by missing quarter.

The maximum number of missing quarters considered is limited to 20. And the number of missing quarters selected is the smallest of the following 2 numbers:

  • Number of quarters between retirement age and age 65
  • Number of quarters missing on the date of your retirement compared to the number required to qualify for a full rate pension.

Example :

If you were born in June 1965 and decide to retire at age 60 with only 161 quarters instead of the 171 required to qualify for a full pension.

The number of quarters between your retirement age (60 years) and your 65 years is 20 (5 years).

The number of quarters missing on the date of your retirement compared to the number required to qualify for a full rate pension is 10 (171 - 161).

Your discount will be calculated based on 10 missing quarters.

Before age 60 if you are entitled to early retirement

You can apply for retirement if you qualify for early retirement before age 65 or before age 60 (for example for a long career).

At any time if you are entitled to a disability pension

You can ask, at any time, to be put at the disability pension if you meet the conditions to benefit from it.

Contractual

You can stop your activity early and receive a specific early retirement allowance (Ascaa) until you retire if you are in one of the following situations:
