You do build your house and you signed a contract for the construction of a detached house (CCMI) with or without plan provision? If the work is not carried out in the planned deadlines or in case of malformation, you can benefit from the delivery guarantee. This is a CCMI-specific insurance. Here is the information you need to know.

The delivery guarantee is a insurance. It covers you (as contracting authority) if the work is not not achieved at agreed prices and deadlines in your CCMI: titleContent or in case of malformation.

It consists of a joint and several guarantee given by a bank, financing business or insurance company approved for that purpose.

The delivery guarantee is mandatory subscribed by the manufacturer. One delivery guarantee certificate shall be annexed to your CCMI: titleContent.

The delivery guarantee covers the risks following:

  • Non-performance or poor execution of works provided for in the contract
  • Non-performance or improper execution in the manufacturing, the pose and theassembly of prefabricated elements
  • Cost of overruns the agreed price if they are necessary for the completion of the construction
  • Chargeable Actions to the manufacturer which has resulted in an advance payment or a price supplement
  • Lump Sum Penalties provided for in the contract in the event of a delay in delivery of more than 30 calendar days (allowances are calculated and payable from 1er day late).

Delivery warranty coverage begins from the date of opening of the construction site.

The warranty ends upon receipt of the work in writing. If necessary, it continues until the end of the period of 8 days following the delivery of the keys to denounce the apparent defects.

If defects in conformity with the construction contract or defects have been reported, the warranty ends when these reservations are lifted, i.e. when they are corrected.

You can implement the delivery guarantee as soon as you see that the delivery deadline is not respected or that the work necessary to lift the reservations (defects and lack of conformity) is not carried out. The implementation of the delivery guarantee is supervised. You must follow these steps:

1Give formal notice to the builder to complete the work

If the construction of your house is not completed within the time limits set by the contract or if it is poorly executed, you must give formal notice the manufacturer to comply with its obligations, by mail RAR: titleContent.

You ask them to complete the work and pay you the late penalties set out in the contract.

If the manufacturer does not respond to your formal notice, you must contact its guarantor. His contact details are included on the delivery guarantee attestation attached to your CCMI: titleContent.

Implement the delivery guarantee

The guarantor gives notice to the builder either to complete the work or to deliver the house.

If the manufacturer does not react within 15 calendar days following this formal notice, the guarantor designates the person who will complete the work.

If your house has reached the stage of waterproofing (completed roofing and waterproofing works), the guarantor can call on a company who will take care of completing the work. In that case, with your consent, he pays the company directly the sums he is liable for.
