Can one be compensated with the confiscated property of a convicted person?

If you are a victim of a offense and that justice has confiscated property belonging to the perpetrator, you can be compensated with the money from the sale of these goods. Such compensation shall only take place if certain conditions are met. We present you the information to know.

Compensation is possible if all the following conditions are met:

  • You have been civil party at the trial to try the perpetrator
  • The conviction of the perpetrator was handed down in an orderly manner definitive
  • The forfeiture property belonging to the perpetrator was finally pronounced
  • The final decision granted you damages and interest
  • The confiscated assets were handed over to the Agency for the Management and Recovery of Seized and Confiscated Assets (Agrasc)
  • The offender has not compensated you
  • You have entered the Civi: titleContent and the Sarvi: titleContentbut these organizations have not compensated you (or only partially).

To be compensated from the goods confiscated of the convicted person, you must send a request to the Agency for the Management and Recovery of Seized and Confiscated Assets (Agrasc). It must be transmitted by letter RAR: titleContent.

Who shall I contact

Warning  

You have a period of 6 months after the day on which the decision granting you damages and interest has become definitive.

Your request must mention the amount compensation from confiscated property, which you claim from theAgrasc: titleContent.

If you have already received a first compensation from the Civi: titleContent or the Sarvi: titleContent, you must indicate the amount paid to you and deduct it from the amount requested.

Your application must be accompanied by documents which vary according to your status (natural person or business).

Natural person

The supporting documents to be provided depend on your nationality and where you usually live:

  • Photocopy (front and back) of your identity document (identity card or passport issued by your country, birth certificate or certificate)
  • Copy of final decision (judgment, shutdown)
  • Certificate of non-appeal or no appeal
  • RIB: titleContent or Postal Identity Record (PIR)
  • Certification on honor, dated and signed, certifying that you have not been compensated by the perpetrator, by the Civi: titleContent or by Sarvi: titleContent (or only partially).

Business

The following documents must be attached to your application:

  • Duplex copy of the business manager's ID (passport, ID card, etc.)
  • Copy of final decision (judgment, shutdown)
  • Certificate of non-appeal or no appeal
  • RIB: titleContent or Postal Identity Record (PIR) of the business
  • Certification on the honor of the director, dated and signed, certifying that the business has not been compensated by the perpetrator, by the Civi: titleContent or by Sarvi: titleContent (or only partially)

First of all, the compensation paid from the sale of the confiscated property of the convicted person is used to settle the damages and interest that have been granted to you.

Furthermore, if the perpetrator has been ordered to pay you the court costs not supported by the state, you can also get their payment from the sale of these goods.

You can freely use the compensation paid by theAgrasc: titleContent.

The period within which theAgrasc: titleContent compensation may vary depending on the complexity of the case and the availability of funds. It can be a few weeks or even a few months.

Agrasc can't give you cash. Compensation shall be paid only by bank transfer.

If you do not have a bank or postal account, you can request in writing (with your first names, surnames, address, date and signature) that the money be paid on the Carpa account from your lawyer.

You can also request the opening of a bank or postal account and send you a RIB: titleContent or a postal identity statement (PIR), to be forwarded to Agrasc.
